Hi,
I have been on a debt management plan since i was 20 - 10 years later i was completed this and paid approx 35k. Im trying to build my credit file and CCJ's i have have been paid and after the 6 year period they have gone.
The only bit I have left is the Next Directory every month since approx 2005. So no CCJ just they mark as a late payment every month.
Ive tried to contact them i get no sense, I get no letter, no contact they just do this each month.
How can i reolve this please? worked really hard to pay my debt off when i could have gone bankrupt. Just scared that they may one day CCJ it.
any help apprecaited.

I'm really surprised that you haven't been able to get in touch with them - they have not been a problem when I have called. In terms of your query, were you under an agreed arrangement to pay them? If so, being Next, they would have put Arrangement to Pay markers (AP) on your CRA file each month that the arrangement went on. If you weren't and hadn't agreed anything with them, then they would be late payment markers ultimately leading to a default.
The problem with AP markers is, unlike Defaults which drop off after six years from their start, AP markers hang around like a bad smell for 6 years after you settle e.g. 6 years from now. This is not the correct use of AP markers which are meant for temporary (6 month's) arrangements. ICO guidelines set this out (to some extent). It is worth contacting them to explain this, arguing that they should have defaulted you years ago0 -
Hi moneyspender1981
Further to simeyb's points:
I would suggest that the risk of Next seeking a CCJ now is minimal, bordering on non-existent, particularly if this was a catalogue debt where no credit agreement was ever signed.
Moreover, if you did not sign a credit agreement, you can argue that you have never given any express consent to Next for your personal information to be processed - this would include registering late payment markers with credit reference agencies.
Can I suggest that you read our fact sheet on catalogue debt (assuming that this is a catalogue and not a store card)?
