Ldk parking charge notice advice needed.

Just received a parking charge notice from LDK for "Not parked wholly within bay". And to be fair they are correct I was parked over half a bay (space at the end) due to the car next to me being directly on the edge of there's so I didn't want my car door to get scratched e.t.c. I parked here after 5pm and there is no parking meter it is just a guy in a hut who takes money as you enter and leave. Iv read a few posts on here and it looks like the best thing do do is completely ignore everything? Im just worried incase they have taken a picture of my car half on a bay and could have enough evidence to take actions further if I do ignore there threats. Has anybody actually been to court because of this LDK group? Thanks in advance :)

    Wrong, you have read old advice unless you are in Scotland/NI.

    if you are in england and wales then you may have been hasty in accepting what you have read, what you SHOULD HAVE READ is the NEWBIES THREAD sticky thread at the top of the forum by coupon-mad , also the RED notice by mse-andrea in between the green banners there too

    then use the forum tools to search the forum for similar cases using keywords
  • If it relates to their actual loss £0.50p - or similar- then pay it. But it is almost certainly a speculative invoice dressed up as a fine probably around £100.00 reduced to £60.00 for early payment.

    If it is - was it placed on your windscreen or via a camera?

  • £45 If I pay within the first two weeks, £90 after the two week period. It was placed on my windscreen in a official black and yellow pouch. Thanks guys I'm going to look through the newbies thread now.
  • Ok iv had a look through that thread and by what I can gather it is telling me not to appeal or do anything until I have received my first written postal letter? As mine was a pcn on my windscreen it can take up to 56 days for this letter to come through. Then check through the notes and compare them to official law. By that time the fine would of doubled so Im 50/50 about what to do. If I was reading old advice about ignore everything that is not correct anymore should I consider paying the £45?

    not really

    there are the opinions based on scotland and northern ireland

    and the opinions based on england and wales

    both types are covered in the newbies thread by coupon-mad and as linked in my signature

    so decide which region you are in and then follow that advice and ignore the other advice

    in any case , its not a fine, it never was a fine and it will never be a fine !

    its a parking charge invoice for a perceived contravention , which may be unenforceable in law , and mitigation never works unless its directly with the landlord or shop/retailer

    Only a court can issue a fine. The police and councils can issue penalties (but not fines). Private Parking companies can do neither.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
