  • The DWP would only go to Court if they believe there is a very very good chance of success in the prosecution.
    These are my own views and you should seek advice from your local Benefits Department or CAB.

    Technicalities aside, when the DWP awards benefit they issue a ton of literature about what changes have to be reported to them. It includes people moving into the home and it is specifically mentioned as an example in the literature.

    Why ask the council who would have zero involvement in DWP benefits paid and zero authority on the matter?

    Even if misinformation could be proved, I think there is still something about the reasonableness of taking advice from that source.

    Asking a different/separate agency and ignoring all the information and letters from the correct one might not be considered reasonable.

    Your ex will have signed statements saying there have been no changes, having been quoted the specific change that needs to be reported to them
