Cancelled DD taken

Hello everyone,

Just checked my online banking, a direct debit I cancelled over two weeks ago and no longer shows up on my list of DD or standing orders has been taken.

I also checked in branch 2 days after cancelling DD online that it was in fact cancelled.

The DD was for over £300 so its left me a bit short on money.

Does anyone know if and how long it will take me to get this money back, it was for my sons nursery that were aware he was not going back as I pulled him out 2 weeks ago, but have still taken the money.

I bank with Barclays.

Any help would be great!!

    Cancel that just looked again and the money has now been paid back in to my account.

    Under the DD guarantee the bank has to refund the money pretty much instantly:
    If an error is made in the payment of your Direct Debit, by the organisation or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society
    Also, the company has no right to reinstate the DD without you authorisation after you cancelled it:
    Money shouldn't be collected from your account after you have cancelled and under the Scheme rules, an organisation would have to obtain your authority to reinstate a cancelled Instruction.

    IIRC the first time a DD is claimed after cancellation, the bank will show it on your statement (usually with unpaid marked against it) so you know that the originator is still trying to claim it. It will not actually be paid though.

    I guess it's designed to help you, so you know the originator still thinks you owe them money?

    And I suspect s/he may well owe them money depending on their cancellation terme. Not the way to collect it though

    I don't owe them a penny. I was paying a month up front, in fact they owe me money as he only did 2 days at nursery last month not the 5 I paid for doubt I will see the £190 reimbursed.

    The payment is originated by the nursery, so it looks as if they haven't cancelled the direct debit on their records.

    You'll need to speak to the nursery to make sure they don't try to claim it again

    If you cancelled it then the bank is 100% liable. The payee cannot reinstate it, only the bank can with your authority.
    No free lunch, and no free laptop ;)
  • A bank cannot reinstate a DD.

    The direct debit was originated by the nursery - it was the nursery that claimed the money from the OP's bank account.

    The bank has been instructed not to accept any more requests for payment under this mandate.

    Therefore the bank has acted correctly by returning this direct debt unpaid with the answer 'mandate cancelled'

    The OP should contact the nursery to make sure they don't originate anymore payments under this DD mandate, otherwise the same thing will keep happening.
