PCN parking eye Advice

Hi. Had a PCN from Parking Eye re overstay in Morrisons Solihull.
I'm the RK but driver was from Southern Ireland (Eire). Are they likely to pursue driver if I give details or should I just appeal as if I had been driving?

do you know the driver?
If so tell the driver whats happened, and then inform them on what will happen next - ie they may receive some scary debt collectors letters but these are nothing but begging letters.
Next complain to the Morison store about this unjust parking charge.From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
if you have receipts and have received the NTK (not a windscreen PCN) then you can try to soft appeal it and get it waived, similar to how I helped on one here
if no PCN was issued then do it at the NTK stage like I had done by my relative

it sounds like you received the letter as RK , so it seems as if the driver has not received anything at all
and you appeal in the third party as the registered keeper (not as the driver, not "I did this , I did that" etc)
so the driver says this, the driver says that
ps:- normally its important not to tell lies , so if you appeal, its as registered keeper0 -
I would appeal as Keeper and win it at POPLA to get rid of it.
Parking Eye have written to drivers/keepers in Germany, in bad German, so I wouldn't put it past them to try to harass the driver with court threats in your case if you give their details and don't appeal.
So I would appeal...and if it were me I would drop it into the appeal that the driver lives in Ireland but will not be named at this stage, however if you should lose at POPLA you reserve the right to then name the driver. I think this will make them think twice about proceeding, especially if you also give the usual appeal points like bad signage, not being the landowner and 'no genuine pre-estimate of loss' and enclose a copy of any proof of purchase as well if there is something. Do it online in 10 mins - and keep a copy first before submitting it as you don't get a copy back from PE.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks everyone for your prompt replies and advice. Called to store today but quite apathetic and I would need to spend at least £80 for them to take it on

I now have receipts scanned, showing 2 transactions at the store during my stay. I intend to email CEO with this and also launch a soft appeal via PE's website. Is there a template for this first attempt? Many thanks0 -

I wish to appeal against this PC as the RK on the following points:
· The driver, who will not be named at this point is an Irish national living in Eire was a genuine customer at Morrisons and has sent me 2 receipts, attached, (£65.97 & £7.15) The 2nd receipt for razor blades was a forgotten item on the first shop, and this together with a coffee in store and 15 mins to initially find a parking space created the overstay.
· This is a "free" car park and therefore my vehicle's overstay has created no losses, damages or additional costs.
Additionally, I have today sent these details to Dalton Phillips, CEO Morrisons.
If this challenge is rejected, then, in accordance with the BPA AOS Code of Practice 22.12, please ensure that you enclose all the required information (including the necessary ‘POPLA code’, details of land owners and a genuine pre-estimate of loss) so that I may immediately refer this matter (and any further issues that I may subsequently raise) for their adjudication on the matter.
I do not expect to receive a ‘generic’ template response and which fails to address the specific issues that I have raised with you. No further correspondence will be entered into0 -
That should do the job as the receipts fit the bill as per the hidden term that PE have in their contract with Supermarkets:

That's an Aldi example but we think PE have this hidden term in their agreement or User Manual with their Supermarket clients (but they don't bother to tell the driver at the time of allegedly forming a 'contract'). I've uncovered during some research that clients can request parking eye to cancel up to 20% of the parking charges issued in any one period and are penalised if they request more! Research has also shown that some stores will only authorise cancellation if a certain spend level has been attained.
This would be relative to the amount of commssion received back for charges collected and this also discriminates between genuine shoppers and their definition and ethos of car parking management -ParkingEye manages car parks to ensure that the car park terms and conditions are adhered to and the parking spaces are used correctly. This, for example, could be to ensure that motorists are paying for their use of parking spaces, as renting parking spaces is a business like any other, or, as another example, that free time limits are being adhered to, which is commonly used by retailers to ensure that there is a regular turnover and availability of parking spaces for their genuine customers.
