mortgage protection claim problem.

3 years ago my wife and I bought our first house together, we took out a mortgage protection policy with the mortgage, just in case, it was split 50/50 so that if either of us were ill half the mortgage would be paid. (I think that's how it was supposed to work)
Last year in February I had a minor knee op and the day after suffered high level multiple pulminary embolisms and nearly died. I couldn't work for 6 months after that, but the insurance company refused to pay out on the grounds that I should have foreseen the PE!!! (How anyone can foresee a PE is beyond me)
Despite letters from my doctor saying that there was no way I could have known about them, the insurance company are still refusing to pay out.
Has anyone got any advice for me please.

If you feel the reason for the refusal is not fair, then you complain. If the complaint is not upheld and you still feel it is unfair, you will be allowed to go to the FOS with your complaint.
Mortgage protection policies are less comprehensive than real income protection plans (PHI - Permanent health insurance). So, there may be clauses in there which allow the refusal which would not have occurred with a full income protection policy.I am an Independent Financial Adviser (IFA). If you have already complained and got nowhere with them then you have 6 months to go to the FOS. However, if you have not complained to the provider, then you should complain ASAP.
