Hi there! I need your advice.
I had £1000 debt with Halifax. Moorcraft was after me. After some months paying in little instalments I've saved up and have made a final settlement offer of £750, they agreed, I paid it and thought thats the end of it. But very soon they started to demand the rest of the money £250.Saying that my circumstances have changed- I did start a job. I ignored them, I thought they are having a laugh. Halifax passed it to Capquest - I've ignored it. Felt its cheating and thought anyway its too small amount for them to take me to court. But now after some silence I receive a letter that debt was passed to new DCA Firstsource. How can I end this chain? Should I write to Halifax and tell that the debt was settled with Moorcraft? Or should I get in touch with Firstsource and tell them its settled and its nothing to do with me? Do you think they have a grounds to pursue the rest of the money after the settlement? Or should I take it easy knowing I would win if in court? Thanks in advance

Did you get written confirmation from moorcroft that your payment was in full & final settlement?. or a letter off them afterwards to say that there was no balance outstanding?
If so then you could send a copy of that to halifax or the new debt collector.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Hi Tixy! Just pulled old paperwork and yes I have their letter saying "...we prepared to accept £750 as partial settlement and remaining balance will not be pursued further...". I've paid and sent them a letter confirming payment and asking for final statement and confirmation of settled account. They send me a letter saying "...in order to complete the partial settlement we require a full income and expenditure on your account...". I ignored it. The next letter was saying "...we have recently been advised by Call Credit reference agency of an improvement in your financial situation and therefore conducting a review of your account...". And that is it. I will send Halifax and Firstsource a copy of the letter, but what do you think about this situation? Any advice you can give? Thanks0

Looks like you owe them £250.
You say they agreed to a 'final' settlement. The letter you mention says partial settlement subject to a I&E form. You ignored that.

So you accepted their offer saying the remainder would not be pursued and paid, and only then they change their mind and try to put extra conditions on the deal? They are just taking the pish and don't have a leg to stand on.Still rolling rolling rolling......

They cant change the rules of the deal halfway through, send a copy of the letter, with a covering note to the latest DCA telling them to refer back to original creditor saying a deal was done on a partial settlement basis, your offer was accepted, you have it in writing, and that you consider the matter closed and will not be paying any further sums on this account.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. I was in the same position as you last year, paid a f & f on a cc. Then this year started getting demands etc. I could not get through to anyone at the CC company thet the DCA had accepted that and it was showing on their systems I still owed. Eventually I wrote a strongly worded letter, sent it to both CC and the DCA. Outcome was an apology and compensation from the CC company. My advice if to fight all the way with them.

Hi all! Thanks to all of you who replied! Even moral police...

Yeah, that is exactly how it went: they put an extra condition on the deal after I've accepted their offer and paid. That is taking a mickey. I have another debt, but this experience had put me off to go the "settlement" route. But we shall see. Also it wasn't a loan- most of the amount was charges and fines.
Anyway, it was good to hear you people, I am more assured now it will be all right. I will send the letters and will keep you informed. Cheers0 -

As lots of you have suggested I've sent letter to Halifax(and to another DCA Halifax has appointed at that time) with a copy of my settlement letter and saying that I do not aknowledge the remaining of the debt, the debt has been settled, that's the copy of my settlement agreement, please inform credit reference agencies... After 2 months of silence today I received a letter from Halifax saying: "As we haven't been able to agree...we've transfered your debt to Wescot...". So Halifax is still hassling me. How can I end it? Cheers0
