So very had the samsung 3 tab 10.1 advertised throughout the day for 129 in their black friday sales. Yes this is the best price ive seen but its black friday and from what ive heard about asda this isnt a strange amount to reduce it by!!!
Anyway long story short ive ordered 2. Stuck them both on my account and had emails confirming they will be delivered next week..... THEN a few hours later an email to tell me it was incorrectly reduced and they will email me in 3-4 days to advise. To be honest I find this ridiculous. Its been on all day. They only just noticed and now I may or may not get them... the sales are on today so im going to miss out because of their error?
Do I have a leg to stand on or not... would like to know so I can just go buy them elsewhere whilst offers are still on

The terms and conditions you agreed to when putting in the order will dictate when the contract is formed, but it will almost certainly have a term that says the contract is not formed until they dispatch the item to you.
Their confirmation email probably does not form a contract, so they are free to withdraw their offer and unfortunately there's nothing you can do about it if they do.
You're probably best off buying elsewhere, but making sure they have a returns policy that allows you to return in case Very do honour the price.0 -

Clearly a pricing error and I would imagine the contract is formed, only when the item is despatched. Therefore you are not entitled to it at this price.
As for Black Friday discounts, people who are looking at huge brand latest electronic items, will notice, nowhere is offering massive discounts on these type of products.
You might get a large discount on some unknown cheapo branded electronic goods, but anyone expecting an Ipad 3 for £150 or even £250 is going to be disappointed.
It is possible that in 3 or 4 days time, they may offer slightly more than £10 off, to those who went to buy them at £129, as a gesture.0 -
Yea ipads are never reduced. But in my local asda tvs had hundreds off tablets were not as cheap as this but better than the price theyve offered! I checked the t&c and yes the contract is after dispatch. I think im just going to cancel everything I bought from them as the 129 price sucked me into buying more stuff for ppl knowing the outlay for the tablet wasn't huge.0

I the same as the post before bought the Samsung tab from very in the "black friday" sales. They have taken the money from by bank account but cancelled the order saying that they will only reinstate it if I pay an extra £150 otherwise I can opt for a refund which will take 10 working days. I know that if a genuine price mistake was made they are under no obligation to honour it but I truly believe it was either a ploy to generate buzz around their sale and get people to buy other goods or to entice people to open credit accounts to pay for it. I after numerous attempts managed to pay using a debit card instead of using the "open a credit account" option page it kept taking me to, only to find out today they still opened a credit account in my name!0

My issue is they say they have 'accepted' my order and also took payment.
For my mind that forms the contact. If the contract is only formed at dispatch which I have no problem with then surely payment should only be taken then?0 -
It says in the t&cs that the contract is at dispatch
I also agree it looked to be a ploy to draw ppl in! Im sending EVERYTHING back to them! They phoned me yesterday but left no message and didnt ring back. Its an 800 number which I cant afford to ring now im gonna have to fork out full price... not to them btw... im not giving them a penny! I hope they phone soon im in a good mood for a chat with them....0 -
If they were using it as a ploy to get people in then that would be a bait and switch scam and wouldn't be legal. If it was just a mistake then that would be unfortunate but not illegal. As long as they don't repeatedly do this then I think its fair to class it as a mistake, not least because I can't prove otherwise.
If they do indeed say that your order is 'accepted' then that is at the very least a poor choice of words though. I'm not sure that it overrides the terms agreed to that say the contract is formed on dispatch, but its more confusing than it should be.0
