    FWIW, I think the strict legal position is as follows:

    You would be guilty of the criminal offence of Fraudulent evasion of VAT!!!

    If HMRC decided to prosecute you, it looks like it would be classed as
    "Single fraudulent transaction, fraudulent from the outset - Less than £5,000"

    - so you would probably only get a community order.

    But if you started making a habit of it, it might become:
    "Fraudulent from the outset and either fraud carried out over a significant period of time or multiple frauds - Less than £5,000"
    - then you could get up to 6 weeks in prison!!!!

    (In theory, the cafe wouldn't care whether or not you pay the vat - because any vat paid will go straight to hmrc.)

    So look out for undercover hmrc surveillance officers loitering in the cafe next time you buy your sandwich...

    I have often wondered why other fast food retail outlets ask if you are eating in or taking away - then charging the same price?

    exactly so!
    maccys and kcf have facilities to eat in - and charge the same price! most chippies with eating in facilities charge the same so to me - this is complete 'sh!te'!

    It's already been explained that hot takeaway food is subject to vat whether you eat in or not.

    Sandwiches are only subject to VAT if you eat in.

    It's pretty straightforward.

    But remember that hot food attracts vat whether eaten in or out.

    So Kfc and McD are correct to charge vat inclusive prices for both.
