Blue Badge PCN theoretical advice if you please.

I would personally send them a written letter with a copy of the ticket and a copy of the BB and inform them that you expect the ticket to be waived because they appear to be breaking the terms of your legal rights under the EQUALITY ACT 2012 which is in effect discrimination and you hold them jointly liable as they are the landowners who have engaged the PPC in the firstplace, you also will consider the matter closed one you have received written notification that the PCN has been cancelled
or you wait for the NTK (if it ever arrives) and then deal with it according to the newbies advice sticky thread by coupon-mad
if she replies to you in this thread, heed her advice0 -
I would await the NTK as said, then make a simple appeal enclosing a copy of the badge and make absolutely no admission that can harm your defence.
Something like this:
Parking charge 9827476
Liability is denied by the keeper a copy of the parking badge is included.
Please forward a popla code with the rejection.
thanks.
When you get either the popla code or refusal to supply one come back ASAP
The BPA have just sent a final warning letter to all PPC about refusal to accept an appeal for any reasons and refusal to include a popla code.
Any further breaches will incur infraction pointsBe happy...;)0 -
Wait for NtK
Appeal to PPC expecting a refusal and POPLA code
Appeal to POPLA using our help.
Win.
Total cost - some stationery, stamps and a couple of hours.

while waiting, study the case of the BB holder in this thread here too

The only thing I would add would be to read the 'successful complaints about PPCs' sticky thread as well as the 'newbies read this first!' one too.
The former has loads of 'disability discrimination' threads (ANY PPC) which will show you how to word an Equality Act complaint as I have written LOADS on here.
The latter thread tells you all you need to know (hopefully) about the appeal to the NTK in due course, and about POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello all a NTK has arrived with a charge notice of £100 any help wording an appeal letter would be appreciated.
The facts are that the car park is free of charge to shoppers(no other options available) the car is registered disabled and is easily identifiable as such by the tax disc, signs and equipment, the vehicle was used in a disabled bay immediately in front of the store where a purchase was made and a valid BB is held.
Wording on NTK
We UKCPS Ltd. are required by law to inform you under Schedule 4 of the * Protection of Freedoms Act 2012 sub paragraph (1),a 7,(2) a,b,c,d,e and f that on the ***date/car details removed*** was observed In a disabled bay without valid badge displayed and the driver of the vehicle is required to pay a parking charge which was fixed to the vehicle in respect of the parking of the vehicle on land at ****** and by so parking he/she agreed to pay the charge of £100 under the terms of a relevant contract displayed on the said land.
Its also worth mentioning I spoke to the customer service of the store and to manageress of a neighbouring store who's chain are the land owners and was advised to ignore the original ticket and I also have been in direct correspondence with the land owners by email whom advised me that I must deal with UKCPS even though the landowners HQ is two minutes away from my home and I could (in my opinion) pop in and show my BB and resolve the matter in minutes without the stress of disclosing confidential information to a third party and incurring the expense of postage or phone calls.(all mentioned in the email)
I have also looked at the UKCPS website today where they mention the advice from this site and other should not be heeded, and looked at their copies of county court judgments (cps website: ukcps dot net forward slash court dot php).
I think that covers everything and I thank anybody in advance that can provide assistance.0 -
''I have also looked at the UKCPS website today where they mention the advice from this site and other should not be heeded''
How amusing!
Just send a 'first appeal' as registered keeper, not driver, as linked in the 'Newbies please read this first!' sticky thread, near the top of p1 of this forum. I am fairly sure I linked a disability discrimination example there. Also, quite often, newbies write their own versions based on the sticky thread advice and paulopepper has just written a perfectly good example of a similar appeal on his new thread.
Let us know if you get any queries and don't respond to pm's (which could be from the PPC trying to get info about you and trying to intimidate you - it has happened in the past).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I sent a recorded letter of appeal as a registered keeper !st class recorded Friday with copies of receipt and BB along with a screenshot of emails to Landowner, Today(Monday) I received an apology email and confirmation of cancellation of charges, I think the cc emails to the landowner helped, they don't like being told they are making thing unnecessarily hard for a disabled person. anyway thanks all on here and I suppose to UKCPS, though I don't think they had much choice0
-
No they don't like anyone who's taken forum advice! -
why don't you try and send your own personal cost notification to UKCPS for incorrectly issuing a parking charge for a disabled person and breaching their legal obligations under the Equality Act - see what happens..0 -
Wow, so many cancelled fake PCNs being reported tonight! Well done!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
