Voluntary Redundancy - Help!

Options
Hi. I am currently on maternity leave and was due back to work in January. Last month I was offered voluntary redundancy which I applied for and it was accepted (although I have had nothing in writing yet) My Manager called me last week and said my last day is to be the 2nd December and he would be collecting my company car the day after (9 days notice!!) I have spoken to HR and they said I would get Payment in lieu of notice but first I have to fill in the paperwork which I haven't received and it could take up to 28 days for the money to come through. My question is, can they take my car away without giving me payment for the lieu of notice and are they allowed to only give me 9 days notice? As I said I am on maternity leave and my statutory maternity pay has stopped now so buying a car at the moment will prove difficult especially as I also have a young child that I have to get to school and I'm not in walking distance. Any advice would be welcomed. Thank you for reading.

Once your employment has officially ended then you are no longer entitled to the benefits in your CoE, e.g. company car. If your official termination date is 2nd December then they are perfectly entitled to collect the car anytime after that. By accepting PILON you have effectively agreed to the early termination of your employment before the end of the contractual notice period. The fact that the money hasn't been paid yet is not relevant unfortunately. The only relevant fact is your official employment termination date and if that is the 2nd then all of your contractual entitlements cease on that day.
Its amazing how these banks can't even do simple calculations correctly..............
