a little advice a lot of help

Hi all

So... my past credit is in need of sorting and i have a number of defaulted accounts from years ago.

Arrow global are chasing for Orange comms - £218
1st credit for Halifax bank current acct. £708
1st credit for Halifax bank current acct. £937
1st credit for Halifax bank credit card £1364
HFC Beneficial finance (store/credit card) ???? - approx £1000

signed up for the experian trial and viewed my report.

1st credit is showing all 3 in default, but not showing AG-Orange, or HFC debts.??? Orange is 5 years ago but the HFC is from easily 8 years ago. I have received comms from both within the last 12 months??

How should i approach this? Spoke to DM services today about a full and final settle on the AG account, but was told any discounted final payment would show as only partially satisfied on my credit report. and to contact AG to discuss.

Also 1st credit has sent a letter regarding the £708 acct offering a 70% discount for partial settlement??settlement in December. should i take this??

I guess to summarise - should i pay AG and ask for full satisfied even if not showing on credit file.
Should i accept 1st credit offer - but will this show as partial satisfied?? could i push for full satisfied??

any help is very much appreciated as i wish to get debt free within the next 12 months for me and my family.

regarding AG i am happy to pay off if they would accept a final pay offer, should i be concerned with it being marked as partial if it is already not showing on my credit file.

also 1st credit accts all become six years old after next june so again should i offer to pay the reduced amount, even if they refuse to mark as full settled??

    ta in advance

Sounds like the HFC debt is not showing because its more than 6 years from when a default was entered.

If the Orange bill isn't more than 6 years from the default then its is possible that it is showing on your credit file with one of the other credit reference agencies, although it would usually shown on experian.

If you are offering reduced full & final settlements it is always best to do this in writing not over the phone, and to get the deal in writing form your creditor before you make the payment.

Some people do manage to negotiate for a creditor to mark a file as though it was fully satisfied even when you pay a reduce sum.

If they will only agree to show as partially satisfied and you go ahead with that it will only be visible for 6 years from the default date shown on your credit file. After that time all record of the debt will drop off your file.

Also having spoken to DM services they made me aware that my Orange contract started in 2001 and the Default date was June 2008, so i can't understand why it is not showing on my file?

does this mean it can't be chased after june 2014 or just that it falls off the credit file but can still be chased/enforced??

The default date isn't the relevant date for statute barred purposes? It is when the last payment or written acknowledgment was made that is relevant. So a debt could be statute barred quite a bit before the 6yr anniversary of a default, or could still not be statute barred for many months or years afterwards.

And of course a debt only becomes statute barred if the creditor/debt collector doesn't commence legal action before the end of the 6year period.

Have you checked your credit files with equifax and callcredit(noddle) to see if it shows on them?

Does your experian file include the address that you took out the orange contact at?
