ParkingEye ticket

Has anyone got any advice on what to do next, I have sent a letter to ParkingEye regarding a ticket stating mitigating circumstances as I was not aware there was a time restriction (I often go to this particular retail area and never knew there was a time restriction) and I had to stay longer than I had planned due to our baby needing feeding before we left. I sent all this information to them and have today got a letter titled 'Letter before county court claim' what should my next move be?

I really feel it is an unfair charge? but am I best to just pay?

Any feedback would be greatly appreciated!?

    How soon after your ticket did you write to them?

    Is this the first reply you have had?
  • There are more knowledgeable on here to help you than I ever could, but I suspect that they may need to know what country you and the parking incident took place. A rough date, if it was a screen ticket or by anpr cameras and what letters you have had from PE, for a start.
  • Need to know:
    - Date of parking event
    - Date you received the Notice to Keeper
    - Date of your appeal, and how did you submit it (post/email, did you get proof of posting)
    - Which country this happened in (England/Scotland/Wales/NI)

    Did you never get a reply? See the advice above and read the LBCCC thread. Remember that if you were breastfeeding a baby under six months old, then for anyone to harass you like this is a breach of the Equality Act 2010 (ParkingEye and the landowner/retailer are both responsible).

    Try an urgent email/phone or personal complaint to the retailer first (Store Manager only!) if this was a Store, or to the retail park management. Remind them of the Equality Act and that this behaviour by their agent implicates them as well.

    The date was the 1st October 2013
    8th November was the notice to keeper, but had the first letter with a pic of our car reg in the car park around 2 weeks after the 1st Oct.

    I submitted an appeal around the same time as I received the notice to keeper as I was trying to gather evidence to go with it. It was submitted via post using the template letter on here and I stated that I was unaware of time restrictions on the retail park and that I stayed longer than planned due to our baby needed feeding, he was at the time only 6 months old and though he was not breast fed, its not something I could of left.

    It happened in England

    Complain in writing to the PPC and complain to the BPA too, that they have not replied to your appeal with a rejection letter & POPLA code.

    Read this thread which covers what to do to win at POPLA when you get that code, and it also tells you who to complain to at the BPA by one simple email, attaching their letters & a copy of your appeal they ignored:

    HTH, any questions after reading those and taking it all in(!) let us know. And what happened when (of course) you complained to the retailer then? Facebook, Twitter, email to CEO, letter to Store/Head Office, or complain in person to the Store Manager with receipt.
