stone found in tesco salad, broken tooth!

Hi there,
I found a stone in a tesco butternut squash and falafel salad that I bought this afternoon. The stone was tiny, well hidden inside the falafel, but as I was eating, it damaged one of my back teeth. :mad:
I took the leftovers of the salad to the store where I brought it from, and complained. In fact, I complained as loudly as possible, even though in a very polite manner (imagine the other customers' surprise, as they could overhear me). They returned the cost of the salad to me and the manager filed a complaint through their computer system. The leftovers of the salad are with them and will be sent for analysis. I kept the receipt of the 'refunded' product, as a proof that I have complained.
I have no idea what compensation they will offer me, but should I expect them to cover the cost of my dental treatment and the travel expenses from and to the dentist?

That depends on whether or not they accept liability, which they wont so a voucher as goodwill will be as much as you can expect.0

And if they do accept liability then it depends on what actual damage has been caused.
Having bothered with trying to get your compensation, have you bothered about getting your tooth looked at yet?0 -

Of course not they will want the millions of pounds of compo then they will pop up to the local NHS dentist get it fixed

I am going to have the tooth checked by my dentist today. With regard to liability, I bet that they will find traces of my broken tooth in the leftovers - together with the stone. After the stone was discovered, I spat the whole thing out and gave it to them for analysis.0

I've had a few cases like this over the years.
I've written a few reports for people, and they've tried to get costs covered.
Once or twice a shop has paid for a filling, often they don't.
It's not going to make you a fortune, and will hardly cover the time & money & stress you expend going after it.
Get it fixed, send them a receipt from the dentist, but don't hold out too much hope. They will have a big legal department and it will not be worth it.
I think they only have to demonstrate they take reasonable care to ensure this doesn't happen - not that it's impossible.How to find a dentist.
1. Get recommendations from friends/family/neighbours/etc.
2. Once you have a short-list, VISIT the practices - dont just phone. Go on the pretext of getting a Practice Leaflet.
3. Assess the helpfulness of the staff and the level of the facilities.
4. Only book initial appointment when you find a place you are happy with.0 -
Should be a simple Band B treatment which is £49.
If Tesco offer compensation or a gift card that's close to that I'd take it. Mistakes happen, especially when dealing with natural produce.0 -
Why did you "complain as loud as possible"?
Were any of the staff in earshot responsible for preparing or packing the salad?0 -

I've dealt with a few claims from people who have damaged their teeth on things in food that shouldn't be there (usually bread as we had a large bakery client). As long as it can be established that the item came from their product they were usually paid out.0
