POPLA said no..can i still appeal?

    so you should have used the no GPEOL defence

    I would also think if it went to court that you could win on the grounds that there is no loss to the landowner , which again should have been in your POPLA appeal

    afaik you cannot appeal an appeal , so a better appeal should have been worded at the POPLA stage

    I will leave others to comment about the next possibilities as regards debt recovery letters etc

    ps:- I used various info and templates on here at that time as welll to challenge a PCN with Excel, just awaiting the outcome but I suspect if will be allowed under the no GPEOL or no contract or some other technicality

    I do not remember seeing any advice or defence like yours

    Thanks for replies so far. I did use MSE to appeal to POPLA and used the template provided but obviously used my own reason for the penalty being wrong.

    The email I rec'd says it is from the appeals admin and had attached a letter with POPLAs address. It includes a sentence ' payment of the £100 parking charge should be paid to the operator within 14 days' and then goes on to give reasons why the feel my appeal failed.

    Sooo I should ignore this and simply await further correspondence direct from Elite or their appointed cronies?


    No, you certainly didn't use a forum appeal for POPLA - that was awful (sorry) and was not even worth sending.

    You seem to have read an ancient old Parking Ticket Appeals article by Martin Lewis from 2009 or something, on the main MSE site which is NOT designed as a POPLA appeal at all (and to be fair to the article it does NOT say it's suitable for POPLA).

    All you had to do was come to the forum and now you have thrown away your certain appeal win and this PPC will be expecting you to pay a stupid amount!

    DON'T PAY JUST BECAUSE YOU WILL NOW GET SHEDLOADS OF DEBT COLLECTOR LETTERS LIKE WE HAVE ALL IGNORED FOR YEARS, BEFORE WE HAD POPLA!

    See previous advice I posted above before, and the advice of the other regulars - only take seriously a Letter before Claim or real court papers (not debt collector stuff).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
