B&M parking ticket - Parking Eye

Hi
I am posting this for a friend.
She parked in B&M car park. She entered the car park at 13:18 - by the time she had parked and got a ticket (the machine wouldn't take her £1 coin) the ticket was from 13:30 until 15:30.
A ticket has come through from Parking Eye.
It says she entered the car park at 14:18 and left at 16:28 (already this is wrong as they have clearly not altered their clocks) so they are saying 2hrs 10 minutes.
But the tickets she had went through to 15:30 (or 16:30 on their times), so no ticket should have been issued.
Does she have a leg to stand on here? Are they allowed to take into the consideration the time taken to find a space, park, sort money out etc before getting the ticket?
Your help will be greatly appreciated as she's obviously panicking about the ticket...£60 if paid immediately of £100 if not.

Yes, they must allow a grace period.
You or your friend need to read the stickies here to discover how to appeal, find out that PE are evil scammers who deserve nothing, and how to shaft them. Challenging their ANPR would be fun, as it's clearly faulty.0 -
either way its a simple overstay so as long as the driver has proof of patronage to the shop then they could appeal on that basis and get it waived (see my own thread on a similar issue)
I also agree they have to allow a reasonable time to exit the car park (or enter it and settle in)
they may not even be authorised by the landowner (like the tesco incident)
follow the advice in the sticky threads on appealing to the PPC and then to POPLA if the PPC wont waive the ticket (its a parking charge - not a fine) - clearly the excessive charge is not a GPEOL so you would assume they would lose at POPLA on that point alone, should they wish to let it go that far for a simple 10 minute overstay
plenty of help in the sticky threads , so if you word this correctly you will win
in any case if the driver gets the shop or landowner to get the ticket cancelled due to shop receipts etc, its job done and no messing about, so thats the first thing to be done, then the soft appeal is next, finally POPLA if the first 2 options fail
if this is in england and wales, do not ignore it, meet all the deadlines
keep all proof , like tickets and receipts, only ever send in copies and scans0 -
I should also say it wasn't a windscreen ticket received, it was from a camera and was received within 4 days of incident0

You should win that one on timings alone - their evidence is simply wrong.
Besides, no-one is 'parked' as soon as they enter site, so yes grace periods are expected.
Anyway - even if you did over stay, and they could could prove it correctly, you'll still have an excellent POPLA case based on the outragous charge level.
Read the posts, it will make you (or your friend) feel better, then fight them. Oodles of excellent advice on the sticky's.0 -

Beggars belief how often we have to point out the sticky threads including one clearly headed up 'newbies...have you got a private parking ticket? read this now!'.
Not only that, the 'successful complaints about PPCs' sticky thread too which is obviously what anyone would do...surely...when it's a retailer?!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The girl has had a response...two different letters sent on the same day from Parking Eye.
The first one is basically asking for the Registered keeper to name the driver
The second one says :
"Vehicles are photographed entering and exiting the car park through our cameras, and should the vehicle within the car park either :
a) Exceed the maximum duration permitted
b) Not pay the parking tariff/the sufficient parking tariff (if a pay and display car park)
c) Not have an authorised permit for the area
...then the parking charge, as stated ont he signage, becomes payable. In order for ParkingEye to cancel this Parking Charge, we will need valid evidence indicating that you did not break the terms and conditions stipulated on the signage"
They have put the charge on hold for 14 days, awaiting a response.
Would the best course of action be to now let them know the drivers' name as well as providing the evidence of the parking ticket being valid for the times they are saying (even though their clocks are wrong)?0 -
No do not name the driver! Have you complained to the retailer yet?0

NEVER tell them who was driver, unless it's a hire/company car.
Redact your post above to remove the bit in brackets, (as I have done) we don't need to know and it gives the PE troll who reads this information more ammunition.
