I ordered a few products from a website and spent enough to get free next day tracked delivery from royal mail. The parcel should have arrived on wednesday just passed but the tracking says it has been delivered and it hasnt. We checked with all neighbours and everywhere outside just in case but no sign of it. We contacted the company who said they would get back to us in 48 hour. They emailed again today asking for another 48 hours to investigate.
Where i live there are 2 streets with the same name and i suspect they have delivered it to the wrong one (royal mail have a bad habit of mixing them up) but this other address claim not to have recieved it. What is likely to happen if they cant find my parcel? I spent £50 for this and would like to have recieved the items in time for my partners birthday but not looking likely now

You have a contract with the retailer to receive the items under next day delivery. They're currently in breach of that contract.
You can request replacement items to be sent out but cannot force them to. You can however request a full refund - but they have up to 30 days in which to refund you.

Would rather not say at the moment until I find what what they plan to do. (Its also slightly embarrasing lol) i have ordered from them in the past and they are normally so quick even without this upgraded delivery so im hopeful they will resolve things. The bit that worries me is if royal mail say they have delivered to "smith street" but they have delivered to the one on the oposite side of town. I have no way to disprove them.0

If is for whoever sold the goods to you to prove that you have received it.
I think I would cancel the order under Distance Selling Regulations and insist on a full refund of all monies paid.
But as has been said, they do have up to 30 days to refund you.0
