ECP tickets...help please

Hi

I know this question has been asked a billion times but really struggling to understand and get my head around all the info on here.

Recently I received 2 x parking tickets from Euro Carparks, on successive days. Didn't feel I'd overstayed the maximum parking time (I've received a ticket previously from this car park which they issued to me even though I'd actually left the car park some 6 hours earlier) so I wrote to appeal, using some of the info on here and requesting more information in relation to the cameras which showed my car leaving/entering.

Today I have received a reply refusing my appeal and giving 14 days to pay £40. (This is for only 1 ticket, I appealed at the same time for both but only heard back from one appeal so far). The letter says 'enclosed are images of your car entering and leaving the car park' but there are no such images attached so I am rather confused, in fact the whole letter is a mess, full of spelling mistakes etc.

There is no mention of a POPLA code either, which I understand they need to supply?

So what do I do next, write to them and request the camera information (which wasn't enclosed, despite what the letter says) and a POPLA code?? It says they only hold the £40 fee for 14 days so I assume they'll put it up during this time it takes them to reply if I write to them again??

Part of me just wants to pay and forget it, can't be doing with the stress of it.

Oh, by the way, I sent a very strong worded letter to the manager of the store complaining. Didn't even receive a response from them!!

  • Are you sure the is no Popla code? The images are totally irrelevent. Double check there is no Popla code and if the is no code write back and demand a code forthwith
Please dont even think of paying, this isnt really stressful if you think about it. its just a few letters that can be calmly dealt with

** and tell them that if it is not forthcoming you will be complaining to the BPA and the DVLA asking them to open an investigation into their non-compliance with PoFA and the BPA Code of Practice.

I've re-read the letter (three times!) and definately no mention of POPLA whatsoever..

Thank you, I will write to them tomorrow to request this information.

Certainly never pay ECP - I have laughed at one of their fake PCNs myself and they never do court. This is NOT stressful, it's amusing.

But you want a POPLA code.

Also complain to the BPA about this reply, point out that it is hardly representative of the BPA's stated aim of 'driving up standards' in this rotten industry when a letter arrived riddled with mistakes and errors and NO POPLA CODE:

    Hello...

    I am back again!

So I sent my letter to ECP around 3 weeks ago requesting a POPLA code and have received NO response from them!!

Also, I appealed both parking tickets at the same time, and have 2 email auto replies. However, I only received a response from one appeal, i,e, which is that my appeal was refused. Never heard anything about the second appeal. Only received one reminder payment notice for the first appeal.

However, today, I have received a demand for payment from Debt Recovery Plus in relation to the second ticket (i.e. the one which I never heard anything back from my appeal). They are demanding £130 to be paid by 2nd Jan, otherwise they are taking court action.

The whole thing is a shambles, ECP are obviously incompetent! Can't quite understand how they have managed to respond to one appeal and not the other, yet now they are chasing me for something they never responded to?!

So what do I do now??!!

send the PPC another email or letter demanding a popla code , as clearly they have passed one on to DR

keep on their case until you get popla codes for both tickets, then take them to popla with help from here

so the same advice as always , which is put up or shut up

    good luck

ps:- DR companies cannot take court action, only the creditor or landowner or his legally appointed agent can do that

''I only received a response from one appeal, i,e, which is that my appeal was refused.''

If there was no POPLA code with that rejection letter then you should have prodded them for it immediately.

I did, I sent a letter asking for it 3 weeks ago as advised on here, but like my post above says, ECP haven't responded to my request. I will send another letter tomorrow and this time send it recorded delivery.

I wouldn't waste money on them; I would not write again and certainly not Recorded Delivery at a time when their office is closed anyway and no-one can sign!

Why not now just email the BPA to sort ECP out? As per the 'Newbies read this first' thread and the 'Successful complaints about PPCs' thread (both stuck permanently near the top of the forum as 'sticky' threads). Both those info threads give you the email addy of the BPA Manager to complain to about such shenanigans (in the latter thread it's in post #3 about who to complain to). Write only as the keeper and remember the BPA represent the dark side, not you, but can shake one of their AOS members into action.
