OK, so now in December & have just received another letter from newlyn saying "court action pending", if I dont pay within 14 days proccedings will be initiated in the County Court. Is this my letter before court or do Excel send that one to me?

Newlyn (debt collectors) have no lawful authority so you can safely ignore. Only the PPC (or their appointed legal representatives, who are not Newlyn) can start court action.0 -
I did write the letter to name the driver, but got distracted with a death in the family & completely forgot to post it, but still have a copy saved on laptop ready for the "letter before court" so like you say I will ignore this one & suppose I might not even get another, ;-)

You can still send that off at any time up to the point when court action is initiated, after that, it's all yours to deal with.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Send the letter to Excel NOW. It discharges your liability, did you not realise the importance of it? Excel may not send another letter, they might go straight to small claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think I would change the PCN to 'letters'.
Also I hope the driver is at a different address, or if not, give a different address anyway (relative's address or workplace). This is to stop Excel whinging that the driver must have already seen the postal PCN.
I would also add that you no longer have the original letter as you knew you were not liable and threw it away, as you weren't driving. Since the driver has not seen a PCN, you suggest Excel will need to send one as soon as possible if they are to pursue the matter with the driver.PRIVATE 'PCN'? Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
