Can I cancel car purchase?
Options
Hi,
My wife and I were looking at cars on Saturday at Arnold Clark as ours is starting to get a bit unreliable. The short story is that at about 4pm on Saturday I signed their 'Vehicle Order Agreement' for a used Hyundai i30 worth £8,000, with them arranging finance. The agreements also specifies the trade in value they will give for my current car, and we paid a £500 deposit on a credit card.
I am supposed to bring in my current car and keys tomorrow, along with the V5 and MOT certificate, but have hit a problem. I had thought that the MOT was due next month and told the salesman this. Now I can't find the MOT, and when I use the DVLA website to check the status using the number on my V5 it says that this isn't the current V5 either?? (All the details on it are correct).
If I turn up tomorrow with the 'wrong' V5 and no MOT then I'm sure they will want more money to offset the trade in value. I'd rather just cancel the agreement, get the old car details squared up, and come back with a fresh slate after Christmas.
What are my options here? Can I go in tomorrow morning and say that I've changed my mind? Will they insist that I buy the new car? Will they keep the deposit?
Advice appreciated.

We have traded cars twice this year, on both occasions we didn't go in the car to be traded. The salesmen weren't bothered as the important details are now all online.
When we gave the trade in details the dealers did an immediate HPI check to confirm ownership, MOT, finance, mileage etc. The first dealership salesman went off to a PC in an office and printed it out, the one last week did it using an ipad at the sales desk.
If there was any discrepancy with paperwork it would have been picked up immediately. I am suprised a huge set up like AC don't do similar as they don't want to be taking ownership of a car with dodgy paperwork.
If all is OK you risk losing your deposit if you cancel. If the terms of the deal are to be changed you are in a stronger position to cancel.0 -

I traded in my car at AC in September and they did the HPI check before even going out to look at my car.0 -
Phone Arnold Clark in the morning. If they say they'll have to offer you less / you lose the deposit, try and get it MOT'ed before you go down.0

You say 'not the current V5'
Did you not receive a new style V5C which is a pink/red colour?
The older V5Cs were a blue/green colour.
I was under the impression that everyone would have received a replacement V5C by the end of 2012.
Have you perhaps not just looked out the 'old' car docs and the current V5C and the MOT are somewhere else in your house?
I say this because I came across my old green/blue V5C the other day and wondered what it was doing in the drawer where I found it.
Mrs Iceweasel put me right - as she often does. LOL0
