    I am satisfied on the balance of probabilities that the requisite prescribed terms and conditions were not contained in, on or together with the document that was signed by the defendant, and therefore I conclude that this is a credit agreement that cannot be enforced.

  • OP I am not at all sure what you are getting at. As jonesMUFCforever says, we give our time free.

    He is not quite correct in saying we are all amateurs as a number of us are financial services professionals in our "real" jobs - or we were but are now retired.

    We express opinions based on our experience.

    If you want personal professional advice then you will need to find a suitably qualified professional adviser - and expect to pay them for that advice.

    One piece of advice I will give is that you should research what you are letting yourself in for. Had you read the top of the forum page you would see that it says "

    As Yorkshireboy says, the card would have arrived stuck to a copy of the terms and conditions, too.

    MBNA has its faults but I do not think the fact that its customers simply bin the those terms and conditions without attempting to read them is one of those faults.

    Exactly... they're on the list of financial companies I would be quite happy to see close down tomorrow, but are they supposed to make potential customers pass an exam on their T&Cs before issuing a card?:rotfl:
