Who are you going to sue and how if you know nothing about the recipient except their bank account number?
The bank could release the name and address of the account holder if they feel that a crime has been committed. There is also such a thing as a court order. At least the name on the account could be obtained if the payment can be traced.
I think the major problem is common law which is used in a number of court cases mostly as a defence such as "Reasonable in the circumstances" and "Reasonable at the time" etc. In this case "reasonable care". If we give a cake to the wrong person and they eat it is it our fault or their fault.0
