Parking Ticket in Scotland question

Hi,
In August this year I parked for more than the 3 hour limit in a large retail car park. I had nothing on my car but shortly afterwards I received a letter from Civil Enforcement. A few months later I received a follow up letter from Civil Enforcement. Today I received one from Debt Recovery Plus Ltd. In the past I have successfully followed advice to ignore but from reading recent forums it seems that ignoring is no longer the best method. I'm unsure if the new legislation applies to me as I live in Scotland where the laws may be slightly different?
If somebody can confirm this for me I would be very grateful as the £140 is the last thing I need to be paying right now...
Many Thanks,
Graykev.

Where in the blazes did you read that?
Nothing has changed in Scotland or NI as POFA 2012 only applies in England and Wales.
So ignoring the scammers and their fake "debt collectors" is still the best method of dealing with a fake ticket up here.
However, it is wise just to file the letters for future reference as a few of them do very occasionally try to have Scots-on by issuing English court papers, which are quite meaningless up here. Most times though you will hear nothing beyond a few scary letters.0 -
Thank you pogofish.
I was meaning that the laws were slightly different in the sense that the changes made to the legislation doesn't apply to Scotland which was what I was hoping for and is what you have kindly confirmed.
I have filed these anyway as you recommend but I will continue to ignore. I felt I'd better look into it a bit more as the Debt Recovery Plus letter was new to me. Didn't receive this last time. Glad to know they are as legally binding as the Civil Enforcement ones though
Thanks again!!0 -
A lot of PPC letters have changed and rechanged post-POFA but the net effect in Scotland is nothing at all.0

Another potential concern I have just thought of is can debt recovery plus or civil enforcement effect my credit rating in any way?0

Nope, it does not.
You should just search the forum for keywords TBH!
Scotland
Recovery
Rating
would be 3 good searches for you as this is covered every week at least.
Use the 'search this forum' facility immediately above the sticky threads, in a title on the right, next to 'forum tools'. Have a look at chickadee13's thread and MimosaDR's thread when you search.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No chance - For that to happen, they would have to take you to court, win, then you would need to fail to pay the judgment and the chances of that happening in Scotland are well beyond minuscule!0 -
You're well fortunate to be living north of the border, where politicians haven't been taken in by BPA-spiel. Take a wee dram and sleep easy, ain't nothing gonna happen
.
Lucky, lucky you :cool:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
