In April 2010 my wife was contact by grass roots finance, they offered a nowin no fee look in to her ppi with hbos and welcome, months and months wentpast and they came up with excuse after excuse as to why it was taking so long.we never heard anything until we chased them or called them for an update, there rep would visit us give us a story and explain my wife had to fill in newforms. In June my wife was contacted by the FSCS on behalf of welcome finance, she replied directly to them and the received this response in the July of 2011at the end of September after the fscs had received my wife's information datedthe 20/07/11, the fscs received a letter of authority from grassroots dated the18/09/11 this was the only contact made to the fscs from grassroots, grassrootsthen sent my wife an invoice for her payout. When we contacted the fscs theyhad received no requests for information just a letter of authority after theclaim was processed. My wife received her settlement on the 011211. Since thengrassroots have employed 4-5 different debt collectors to try and claim money, however when I explain this to them they never come back to us, now we have afirm of solicitors called temple and co trying to force my wife intobankruptcy, they do not respond to my emails or answer when I call, they justrepeat the same thing over and over "you have not contacted us we will nowcommence legal proceedings" What should we do?

Write to them basically what you have said here. Also, state that you feel that grass roots finance harassment to get you to pay for a service they never provided is going too far and you will consider legal action against them if it was to continue. Also ask the rhetorical question as to whether it is lawful to bill for services that were not provided.

They will probably come back saying "it is in the contract". If so then you can counter that a term in a contract allowing it to charge for a service it did not provide amounts to a breach of the Unfair Terms in Consumer Contracts Regulations 1999 and is therefore void.

How much are they claiming she owes?
