Yes it is his to sell and is not on contract - my brother has the receipts it was a replacement for a broken one, but he decided that he would sell it and use the cash on a high end Android for half the price
I like the look of the Samsung Galaxy S4, many people I know are moving from Apple to Android because of the way the phone is not improving much. Siri is probably the only positive thing of the new iPhone lately.0 -

That's very sad
I bought my new, boxed, unused, unlocked iPhone 4S in September last year. I paid immediately, seller sent very quickly - 2 happy eBayers

I have to agree with the shared sentiments of those suggesting Gumtree or Pay on Collection.
Not every buyer is bad on eBay, but I had my own issue with selling an iPhone 3G on eBay (which I documented in another thread) and eBay were all too quick to side with the buyer.
I recently sold something on Gumtree for the first time. I was all ready to sell it on eBay, but having read some horror stories regarding this particular item (a very expensive set of coilovers for a car), I decided to use Gumtree instead. I got plenty of phone calls and after about a week, someone came and picked them up.
I think from now on, my use of eBay will be for buying bits and bobs only.0
