Currys refund issue

I wanted to check out whether what has happened to me at Currys is within their rights or not. It doesn't seem ethical - so wanted to check with those who know!

Last Friday I may an online order for a new washing machine, and within 10 minutes I cancelled it via telephone. They advised me I could be charged but it would be returned within 24 hours.

Slightly contradictorily, I received an email telling me that they had cancelled the order and that my card would not be charged.

· Roll on Monday ......... card was debited for the full amount. Slightly annoyed I thought not a lot of it expecting a refund within 24 hours.

· Tuesday comes and goes no refund so I contact Currys – very nice lady told me to check tomorrow.

· Wednesday no refund

· Thursday call Currys to discuss – told there is a backlog since 12th Nov, and they will get to it as soon as possible. A chase was applied

· Today – still no refund.

Is it just me – this doesn’t sound legal? Perhaps I’m wrong?

    They have up to 30 days to refund you.

    Anything before that is a bonus :)

    What looks like has happened is the payment is taken as soon as the card details are processed, which must have been when you made the order.

    I'm not sure if they could cancel the transactions, once that has happened, even if you had spoken to them with 30 secs of the purchase.

    If it's not possible, then I guess they have to wait until the transaction is charged and they receive payment, before processing a refund.

    As it's been taken, I would imagine they have upto 30 days to refund you.

    While, you may have been misinformed and therefore, that is something you could complain about, at the end of the day, you cancelled, so they can take as long as their T&C's allow them, to return the money.

    Not correct op ordered on line and then cancelled, therefore refund falls under DSR and has to be paid within 30days,from date of cancellation, Currys T&C can not change that.
