Letter from debt recovery plus ltd but no ticket
Comments
-
Hello, I'm back! DH has just opened a letter from Debt Recovery Plus offering him the chance to pay a reduced payment to avoid court proceedings. Apparently if he doesn't contact them to do this ASAP the parking company will start court proceedings at the full price and seek to recover court costs as well.
Do we stick, twist or fold?0 -

Do we stick, twist or fold?
Definitely stick. DR+ can't issue a claim, only the PPC, landowner or solicitors representing either of the latter two. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thank you for your replies. The debt recovery company aren't threatening to take DH to court, but saying that they have "referred the case to the creditor with the recommendation that they appoint their solicitor to commence court proceedings against you".
The letter continues:
"In order to comply with all aspects of 'pre-action protocol' and to demonstrate to the courts their attempts to settle this matter before the need for court proceedings, our client is prepared to accept a reduced payment of £xx.xx in full and final settlement... This is our client's final offer before they pass the case to their solicitor. If you do not pay the reduced amount by xx/xx/14, or you have not agreed a payment option with us by then, the amount due will go back to the full amount of £xxx.xx and the matter will be referred to their solicitor to consider court proceedings".
Is it time to write to the PPC or G24 about all this, disputing the claim under POPLA, or is it too late?
I'm sorry to sound so thick about this but I'm tired, it's nearly Christmas, I've never had to deal with this before and getting shirty letters threatening DH with court action worries me!0 -
Did you actually go to the thread I linked to? This will not land up in a courtWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Thank you, that is very reassuring. I'll advise DH to ignore for the moment.0
