Broken playstation 3 caused by GTA5

I wondered if anyone can help.

I own a 5 year old playstation 3(out of warranty) and I have been playing GTA5 and during my play my playstaion switched itself off and has now been broken.

When I researched this I found on the playstation forums that this is happening to a lot of people and what is happening is that as gta 5 is so powerful it is breaking the playstations internal circuits and burning them out. I today spoke to Sony and they are fully aware of this however their only option was to pay £110 for a replacement console.

I am wondering what my rights are as sony/playstation have admitted liability in having a game which is breaking consoles and it is no fault of the console owners and I was not aware of this issue when I purchased the game.

Any help would be great.

    How do you know the circuits are burnt out ?

    If the fault is inherent rather than due to misuse or fair wear and tear then the retailer (not Sony) will have to provide a remedy. However as it is more than 6 months since purchase the law will assume the fault is not inherent unless you can prove otherwise.

    The retailer has to repair, replace or refund. But you can't insist on a remedy that is more expensive than one of the others, and they are allowed to deduct money from the refund to account for usage. After 5 years I imagine the deduction they made would be near to 100%, even if you did manage to prove the fault is inherent.

    The other option would be to pursue the retailer that sold the game, but I imagine you would have a job proving the game was at fault.

    If you type into google 'broken ps3 gta5' the first link shows over 17 pages worth of forum conversations from playstation owners unhappy with the same problem as me.

    I bought the item from Game but I would imagine they wouldn't help as it's out of warranty-I'm sure they will just say "contact sony"
  • A few things, you're confusing warranty, with your SOGA rights.

    Then you've got to decide who you'd have the case with. If it's the game which you truly believe has damaged the console. Then wouldn't it be the retailer of the game you went after?

    Which one are you suggesting is at fault here, the game or the console, or both?

    Both will have warranties from the manufacturer, you're bound by those terms. Your real rights are with the retailers under the SOGA but as has been said with a 5 yo console any refund would be negligible IF you even had a case.

    Then I'd be VERY careful about putting in writing a massive multi national company has admitted liability for anything. Unless you've got deep pockets and are absolutely sure and can prove what they said.

    They also arent the same company today that you bought from 5 years ago.

    Have Sony said how the £110 replacement would be any different? Is this a particular batch that has a problem or not? 5 years is a pretty good amount of time for a console to last to be honest...
  • Well I'd say by playing the game it has broken my playstation which Sony have confirmed has occurred on several occasions so I could speak to the people who made gta5 and see if I have any luck as I bought the game at a local tesco and if I take it into a store and say 'I bought this game and by playing it it's broken my ps3 they will just say on your bike'

    I will also try to get something in writing by playstation confirming they are aware of this issue so I have some sort of proof

  • Visidigi-it only seems on the forums that it has happening to the older playstation 3s and not the newer 'slim' ones as the older consoles cannot cope with the game and it's causing the disc readers to break and make the console useless

    Unfortunately I can see you having little to no chance of getting them to do this, even if they had verbally told you. They would open themselves up to a world of trouble and cost if they said 'we know there is a game which has been developed for the PS3 that breaks them, but we have kept it quiet'.

    The problem you have is that GTA hasn't broken millions of PS3 consoles so proving the fault lies with the game will be difficult.

    Posters above have covered your rights with the PS3 under SoGA.

    If the replacement for £110 is a slim...thats not a bad offer to be quite honest...your SOGA rights would be hard to enforce at full value, they are allowed to reduce for use, so say for example you paid £300 for the console you're probably looking at a residual of less than £50 (there is no concrete proof of these numbers, its an estimation and not gospel!).

    If that's your proof. I wouldn't be throwing around wild statements, such as they've accepted liability.

    That's not accepting liability. Saying something has occurred on several occasions. You'd expect that one of the biggest selling games to come out on the platform, where millions and millions buy it...you'd expect console failures by sheer coincidence and statistics.
