    Always wise to have restrictive covenants in contracts to ensure people realise you are running a business responsibly, but any agreement is there as fair game for the lawyers to tear apart if someone's daft enough to pay them. If the person was in sales, it's always difficult to keep re-motivating them, the best always move on to "new challenges". Two points that I'm sure you'll cover next time if it arises OP is that you never allow a resignation retraction and you always secure, as far as possible, company information.
    Sounds like you are well shot of that employee and the few pennies an hour the new employer threw out to buy business from you has failed.
    Be polite when they call looking for their job back!
