Do I have to pay an Excess Charge Notice

Hi

My wife returned to her car 4 mins late and found a ECN on it stating Parking without a valid ticket issued by LPS.

I tried to pay the reduced amount of £50 online but it stated the number was not recognised. I tried to pay on the phone but it stated the number was not recognised. I left a voice mail stating my predicament, I sent a contact vis their web site stating my problem.

I have now received Notice to Keeper.

I have read post from people that we should just ignore it all.

But should I ??? :mad:

    Dear Sir,

    I would like to inform you that on receipt of your Excess Charge Notice No. 00000008, I attempted to pay the reduced amount of £50.00 online at www xxxxx as requested.

    All I received was a notice “Failed to retrieve details – Please try again later”, which I did, again and again and again. Each time I received the same message.

    I tried to pay via your telephone line on 0844 474 0904, but on entering the number 0000008 and my registration number I was informed that the number was not recognised. It did not give me any other way to pay.

    I visited your website and left a contact message that I had been unable to pay online or on the telephone and would you contact me to arrange payment.

    The first contact I have received from your company is a Notice to Keeper letter.

    I think that this is most unprofessional of your company nor respectful to myself, who has tried to pay by all your advertised options (apart from sending a cheque, as I do not have any) the reduced amount of £50.00, albeit I find this amount to be disproportionate as I exceeded the expiry time by 6 minutes. According to the Unfair Consumer Contract Regulations, parking charges on private land must not exceed the cost to the landowner during the period the motorist is parked there. In my case, the £85.00 charge you are asking for far exceeds the cost to the landowner of £0.50p for one hour of parking.

    “Charge” is also an unfair term in pursuant to the Unfair Terms in Consumer Contracts Regulations 1999, Section's 5, 6 and 8 and Schedule2, Unfair Contract Terms Act 1977 section 4.

    Please inform me how I am supposed to pay the amount if the number you provided on the Excess Charge Notice is not recognised.

    You don't need to pay a thing.

    Please read coupon mad 's sticky thread at the top of this forum offering guidance to newbies. Under no circumstances send that letter unless you have money to burn. Be glad their system rejected your attempt to pay.

    1) The amount charged is not a genuine pre-estimate of loss
    2) You do not have the authority to set charges at this site
    3) Your signs do not comply with the bpa code of practice
    4) You haven't given an adequate grace period to leave the site
    5) Your named Excess Charge Notice is a claim of authority and complaints to the bpa & dvla has been submitted

    If you reject this appeal, please forward a popla verification code so we can cost you £27+vat to get this cancelled, as you are probably aware popla upholds all appeals when the points above are used.

  • And take a look around the forum as to what to do with an NTK.

    Basically, make an simple "soft" appeal; get a POPLA number. Appeal to POPLA Save yourself their "Excess Charge". Cost them £Over 100.00

    Win-win.

    BUT DON'T PAY - DON'T SEND THAT LETTER, AND ABOVE ALL DON"T ADMIT TO BEING THE DRIVER.

    Your only problem was you actually fell for the scam fake ECN and tried to PAY!!!! :eek:

    See the advice you have been given and - if this was in England/Wales - send a decent appeal as registered keeper not implying who was driving. Just as you would have read about if you had clicked on the sticky thread for newbies near the top of the forum:

    How did you miss that advice at the top and yet find old advice from many months ago...? :)

    Please send complaints on the Excess Charge Notice, this term can only be used by councils, they using it is an abuse, and it could be deemed as a claim of authority. Don't say you were the driver, just say that you are the registered keeper, scan your letter in to them .
