PCN advice on driver circumstances

Hi, I have been reading threads about this for the last several hours but am still not sure on the best way to proceed in my situation, so would really appreciate advice.

As the registered keeper of the vehicle, I received a PCN from a private company with ANPR today - from an overstay of a free parking period at a retail park.
As far as I can see they have complied with rules within the letter.
I will be writing a short letter to them to contest as suggested & asking for a POPLA code, as well as writing to the store manager.

What I am a little unsure of is.. the driver at the time is not a resident of the UK - do I stick with the not disclosing the driver, or would I be better to give the details - how will they pursue a resident of another country or can they then stick the charge on me anyway?

Thanks so much for any help - I'm a worry merchant at the best of times and although I realise the charge is unenforceable I don't think I could cope with the stress of threats etc by just ignoring it.

Was there a windscreen ticket at all? Or was this the first notification?

You could have fun and name the driver and their (overseas) serviceable address. :D This absolves any liability you would have under POFA 2012.

Alternatively just follow the usual NtK appeal/rejection/POPLA win process that applies for everyone else. Ergo - your situation would NOT be any different. :)
  • It was G24
  • There was no windscreen ticket, the letter today is the first notification.
I wouldn't want the driver getting penalised really though.. so not sure of the best option to take. Thanks for your replies.

If you want to keep the driver out of it, then follow the same advice given to EVERYONE who receives an NtK as the first notice. (See the stickies).

In that situation YOUR POSITION IS NO DIFFERENT. :)

Date of offence, date on letter, confirm you are in England/Wales.
  • Thankyou - Would it be likely that they would follow up someone from say 'Spain' though? If the driver received & ignored the charge, would they be likely to proceed with threatening court etc? Obviously naming the driver would be the simplest option for me but will I just be passing on the grief!
  • Offence 8th Nov, date of letter 18th Nov, yes England.

Do what this person above has done and complain to the Store Manager or retail park Centre Manager - and appeal as per the 'newbies...read this now!' sticky.

You could give the name and address of the driver but these PCNs that allege 'breach' are so easy to beat at POPLA you may as well use it as target practice with a POPLA appeal so you know how to beat these if you ever get another. Try the complaint first though as you have time.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Thank you, I will definitely do that.
