  • Hi again. Finally received official rejection. Claims of being able to enforce the POFA as they don't have the driver details........but an option to appeal to POPLA.

    I have rejigger my earlier post of the appeal making GEOL more obvious and taken the other suggestions on board.

    Can I ask if there is any other supporting things I should send? 1photo of their entrance sign is included, where it is claimed it forms the contract, but I probably won't be sending any other pics of signs as they are not the sole appeal point......unless it's suggested they would help?

    Any further final advice would be very welcome from anywhere.

    They did supply the POPLA code???
  • PS: POPLA Form give 4 reasons for appeal. Which one is mine, they don't really fit.......I go literally by 'not liable for charge' but the outline reason of stolen vehicle or new ownership via sale doesn't apply.........the other 3 reasons don't seem relevant........

    I'd appreciate an opinion

  • Thanks for your help and suggestions. I have now posted my POPLA form and will await the adjudication. I am more than happy to share the result, either way, when I recieve it.............

  • Evidence pack sent to me by POPLA

    Contain 1 video 52 seconds long
    Graphics of signs and layout
    A contract between PPC and Airport (redacted)
    A breakdown of GPEOL including cost to issue PCN, indirect overheads, PCN process, cost associated with appeal....etc
    + a statement of cases supporting the idea that parking charges are not penalties just because it is a breach of contract.........

    They have not addressed my request to see CCTV maintenance schedule or evidence of compliance to the Information Act
    They have not addressed the rerquest to see evidence that the land is not already covered by 'by-laws' or that the act of stopping in a roadway cannot be called parking.

    Guess this is going to be pretty standard stuff.....anything there that I should be worried about ?
