my br update

To be honest, i feel like s***t right now, ive spent a lot of years on this board, and thought id learned, which i did, until it came to my daughter, and funding her further education, ive not spent anything on frivolous things, since this boards founder, mike, ended my marriage, guess that comment will get this deleted, but i can find people to back that up! anyway, i found work, and was doing fine, even though i was now a single dad until tax credits used experian and accused me of not being a single parent, this all happened in the last nine months, I had to resort to credit, to fund my daughters education, that was fine, not ideal, but a necessary evil, until tax credits didn't back down, apparently, holding a marriage certificate means you're not entitled to claim single person benefit, no matter how many partners your ex has had, one financial connection on experian over rules the fact my wife cheated on me, several times, but im left, according to to tax credits, needing to prove that, while there own guidelines say , they cant involve a third party, nor expect me to provide evidence to the same?

  • 3 Claims

    (1)Entitlement to a tax credit for the whole or part of a tax year is dependent on the making of a claim for it.
    (2)Where the Board—
    (a)decide under section 14 not to make an award of a tax credit on a claim, or
    (b)decide under section 16 to terminate an award of a tax credit made on a claim,(subject to any appeal) any entitlement, or subsequent entitlement, to the tax credit for any part of the same tax year is dependent on the making of a new claim.
    (3)A claim for a tax credit may be made—
    (a)jointly by the members of a married couple or unmarried couple both of whom are aged at least sixteen and are in the United Kingdom, or
    (b)by a person who is aged at least sixteen and is in the United Kingdom but is not entitled to make a claim under paragraph (a) (jointly with another).
    (4)Entitlement to a tax credit pursuant to a claim ceases—
    (a)in the case of a joint claim, if the persons by whom it was made could no longer jointly make a joint claim, and
    (b)in the case of a single claim, if the person by whom it was made could no longer make a single claim.
    (5)In this Part “married couple” means a man and woman who are married to each other and are neither—
    (a)separated under a court order, nor
    (b)separated in circumstances in which the separation is likely to be permanent.

    (6)In this Part “unmarried couple” means a man and a woman who are not a married couple but are living together as husband and wife.
    (7)Circumstances may be prescribed in which a person is to be treated for the purposes of this Part as being, or as not being, in the United Kingdom.
    (8)In this Part—
    “joint claim” means a claim under paragraph (a) of subsection (3), and
    “single claim” means a claim under paragraph (b) of that subsection.

  • No more replies? by my reckoning, tax credits owe me about 1.5k, plus out of pocket expenses, which will double that, they claim i owe them 4.5k, invited them to to take me to court.......still waiting, funny that? as legal aid is no longer available against government departments, so taking them to court is not an option, but if they are so adamant i owe them so much, why have they not started legal proceedings? been waiting six months........

  • I don't know the background and it does sound very acrimonius. Maybe your local Councillor or MP would be able to help?
    When did your Oh leave the family home? Have you claimed single person discount since then? DO you have an address for them?
    Can you contact Experian (or whoever it was to get your ties severed)?
    What about a mortgage or rental agreement? Do they prove you have split?
    Hope you can prove to them that the split is permanent and get the mess sorted.

  • I never had any issues with TC claims even when legally married but living as a single parent, i cant recall being asked about the dragon

    I had no idea that you had to prove you were 'single' for tax credits! I've never been asked to do that despite still technically being married and still using my married surname - separated since 2005 though?

    The Benefits and Tax credits board probably has some members who know more about the issues than the Bankruptcy board.
