Tesco Online

Options
Hi
Looking for advice.
In August last year my daughter bought a Dell computer from Tesco Online through their e-bay site.
It has now packed up. The computer has a beep code relating to the fault and indicates CPU or something.
I message Tesco online and quote sale of Goods act which they have ignored. This is their reply
"Good morning,

I am sorry you are now experiencing problems with your order. The Tesco Outlet 12 month warranty on this product has expired. We can accept this back for further investigation, but this will be for a repair service only."

I'm unsure about the next step. Quote EU regs. Give them 28 days or what?
Advice appreciated.

It appears to be repair at my cost. Not under the guarentee.
Thanks anyway. I will contact them again for full clarification. They are quoting a 12 month guarentee and not acknowledging SOG or 2 year EU.
maybe I'm being a bit harsh.
Thanks for pulling me up. Getting earache off daughter:)

They won't repair under the guarantee as this has expired.
Your next option would be to get the computer examined by an independent computer engineer or company to find out what the problem is and how it was caused.
If it turns out to be the case that the problem was caused by a manufacturing defect, then you should contact Tesco again and inform them of this.
You have rights granted by the SOGA that allow you to attempt to claim for faulty goods for up to 6 years from purchase (but this doesn't mean that all goods must last this long), and providing that you can prove that the defect was due to dodgy manufacturing, then the retailer has an obligation to offer some sort of remedy - repair, replacement or refund (this can be a partial refund)

2 year EU doesn't apply here, we are better protected in the UK by our own terms of SOGA.

Ensure you read the information in the sticky posts at the top of the consumer rights forum for more information on what to do next.

Shaun is right - Tesco don't have to do anything under the SoGA until you present them with an independent engineers report which says that the fault is inherent.

If the report states this is the case, Tesco should refund the cost of the report and repair the machine for you.
