Smart Parking Charge Notice

Hi guys
I have seen a huge amount of useful information referring to parking tickets and I have today received a "Notice To Owner - Do Not Ignore" message from Smart Parking.
Apologies for this thread, I did honestly view all of the other threads although still a little unsure on how to proceed, do I ignore? or appeal? - looks as if I may have overstayed my welcome
Can anyone please advise...using baby steps

Hi and many thanks for the fast response, could you please confirm that I am sending my first communication correctly? I am under the impression that I should send something along the following lines and then seek further advice once I receive a POPLA code? Or is it better to bury head in sand and ignore....??

I am the Registered Keeper of the vehicle with registration number XYZ and have received your speculative invoice # xxx on yy.
Please note that I wish to appeal this invoice as you do not have the right to levy a "parking charge" and thus it is not due. You have insufficient capacity over the land to offer the driver of the vehicle any contract for parking (irrespective of whether such a contract has validly been formed and whether any of the terms you purport to apply have validly been incorporated). Further, the charge you purport to levy is clearly for Liquidated Damages but you have not provided any proof whatsoever that it is a genuine representation of loss.
I thus assume that you will cancel this charge, should I not hear otherwise from you within reasonable time.
Should you however think you have a valid claim and wish to uphold your charge then I expect that you will provide me with the means to refer your claim to the independent arbitrator

That's a good appeal, send it online and it will cost you nothing. Don't forget to also, urgently try the simple remedy of complaining to the Store Manager (Asda?):

Which car park was this? (You say you're a Geordie - so am I but I don't live in Geordieland any more. I'm in Scotland where things are different, and PoFA2012 and POPLA don't apply).
