Parking Eye Charge - how to dispute

Hello.

I've read a lot of advice on the internet regarding this issue, but before taking any action, I would just like to double check I'm doing the right thing.

Today I received a charge from ParkingEye for staying too long in an Aldi car park. I'm 37 weeks pregnant, so not quick on my feet. I also do the shopping for my own family and my elderly father in law who has dementia. Unfortunately I was parked in the Aldi car park that allows 90 minutes parking free, and I was 2 hours. I admit, that day I felt a little weak and therefore following the hurried packing in Aldi, I then sat in the car for 10 minutes to have a drink and something to eat. I did not realise I had gone over the 90 minute limit. I probably spent too long browsing and taking my time with the shopping. Probably also ended up spending more money than planned as well, which I'm sure Aldi will be happy about. But I've been thanked with this charge.

I believe that a) these charges are not technically legal, b) under the Equality Act they cannot really pursue this charge as I'm pregnant and I'm also shopping for my ill father-in-law.

Can anyone help clarify what is the best way to dispute this charge? I have written to Aldi already. If there is a letter template available, if anyone can point me in the right direction that would be so helpful?

    Regrettably, the "parking industry" and POPLA are not persuaded by the law regarding Equality matters. I fear that this very valid argument but needs a court to appreciate the argument, or an enlightened store manager.

    Coupon-mad is well versed on the law on this and will help form an appeal that includes this point.

    You should prepare, however, to also go down the well-proven route of successful appeal points to POPLA in due course. That's a bit off yet, so one step at a time and do follow the previous post.

    This is my appeal as I am the driver of this car.

    The situation is that I am heavily pregnant - baby is due by Christmas - and after shopping for myself and my elderly relative I felt weak. I had to sit in the car after loading my shopping into the boot, and have a drink and something to eat. So I was parked for longer than the usual maximum period but could not leave until I felt well enough to drive home.

    As I hope you are aware, I am currently protected by the maternity section of the Equality Act 2010. It would be unlawful to harass or cause other detriment to a pregnant woman such as myself, for any reason connected to my condition. I attach a copy of my receipt and have also written to Aldi to complain. Please confirm that this charge has been cancelled and if not, you must try to justify your reasons and send me a POPLA code.

    +1 for coupon mad. PE are known to cancel when you send in receipts showing a spend at the shop. Use a redacted bank statement if you don't keep receipts
