Not informing the 2nd Job place about the first job

Hi,

I have a friend who recently was offered a job role in a xxx company. But in the interview he told them that if he gets the royal mail job(temp contract work) he will quit the job as he thought if he said he works full time in other job he might not get this job.

Does he need to give a P45 when he starts the new job.

Or can he mentioned to the new payroll that give the tax code 944L to this new job. (He is thinking to say that he can get few months NO PAY Leave as in real life situation few employees have taken NO Pay leave to attend other matters)

Since this jobs pay more salary than his other job can he contact HMRC/Employer and informed to change the Original jobs tax code to BR.

*** This is about just to have both work and not trying to escape from tax.

    He can have two jobs, or more if he has enough hours in the day. Unless there's a conflict of interest you don't usually have to tell one about the other. If both are PAYE jobs, the tax will be sorted out by the payroll dept, and there's a form that he will have to fill in with details of his other job and they will then allocate the tax code. If he doesn't give up the other job he won't have a p45 and this other form (wish I could remember what it's called, I have had so many!) will do instead.

    I work at 5 jobs and tax works out fine though I do send in a self assessment each year to make sure. No reason why he can't work at several at the same time.

    I quote because he doesn't need a P45, but will need a P46 and on Page 3 it asks to state which one of A, B or C applies

    A - This is my first job since last 6 April and I have not been receiving taxable

    Jobseeker's Allowance, Employment and Support Allowance, taxable Incapacity Benefit, State Pension or Ocupational Pension
    .

    B - This is now my only job but since last 6 April I have had another job, or received

    taxable Jobseeker's Allowance, Employment and Support Allowance or taxable

    Incapacity Benefit. I do not receive a State Pension or Occupational Pension.

    C - As well as my new job. I have another job or receive a State Pension or Occupational

    Pension

    That means that he will have to tell the Payroll department of the new employee, that he has an existing job.

    Typical use would be where the new employee has lied about his previous salary, in order to negotiate a bigger one, and will tick that B applies.

    The OP's friend needs to tick C.

    I'm guessing that this will result in them suggesting he look at the T&C's of employment, which will probably say he needs to tell them of other employment (it's a standard thing I reckon) so that they can decide if there is a conflict.

    I think being upfront when now would work in his favour, he's decided he can do 2 jobs as he needs to pay off some debts etc.

    Can he says for the sake of filling the P46 as the new job is his only job, and that he will be taking NO PAY Leave for few months as the new job is a 4 month contract. So for job security he will take leave from his current job and work here.(The new job pays a very good hourly rate)

    Then can he speak to the HMRC and update his situation and informing them to give a tax code of 944LL to the new job and give a BR code to his present job citing that new job even though is short term still pays better money

    No he cant because it isn't his only job, he does have another job, even though he is on unpaid leave.


    Why would he want to anyway,
    The tax would sort itself out in the long run.

    P46 are not the official form though the questions in the starter form are pretty much the same.

    If he has not resigned from the first job or been dismissed, then he still has that job. If he wants to get the tax-free allowance transferred to the second job, he can ask HMRC to do this - they would write to both employers.

    However, if he doesn't do this, as soon as he returned to carry out paid work with the first employer (in this tax year), he would reap the benefit of the tax-free allowance which would have accrued. He would just have to be sure that he would be paid before 6 April 2014.

    If that looks like not happening (ie first employer would not be paying again until on or after 6 April 2014), then he definitely needs to get HMRC to transfer the code to the new employer.

    Thanks for the reply.
    He will be doing the both jobs just to give and excuse why he cant give the P45 to new employer he is planning to tell them he is on unpaid leave.
    Therefore he wish the new job to be under tax code 944L and Old job as BR.
    Can he speak to HMRC and ask them to do the tax code swap?
