I parked outside the maternity ward of our hospital when my wife was giving birth, I paid and displayed for 3 hours but overstayed and ended up returning to the car 42 minutes late, just as the attendant was walking away from my car. I didn't realise the rules had changed in the last 12 months so just walked away from the car and then ignored any letters associated with the ticket.

The PCN of £50 (£25 if paid within 14 days) was given on 02/09/2013 at 11:15 and the ticket ran out at 10:33. Incidentally my boy was born at 09:45.

The reason for the ticket was '1. Parked without displaying a valid payment' though '8. Overstaying the displayed time limit' would be the correct breach of contract code.

The terms and conditions are clearly displayed though I did not read them as I was in kind of a rush! There is also no other option for parking as there is nowhere near and I couldn't expect my wife to walk anywhere whilst in labour!

They sent a letter to the registered keeper dated the 11 October 2013 though I cannot recall when it was received. This too was ignored as I didn't bother to check to see if the law had changed! :(

This was referred to R0sburghe who contacted me last week with a letter dated 13 November 2013 saying I have to pay £104 with no time limit for payment.

Just on the off chance I did some searching on the company and came across all the new posts giving the new laws that have come in to force and so am now at your mercy to see if you can help me!

The original V1nc1 letter does have a statement about POFA 2012 but the R0xburghe latter does not.

I think that's everything, though please ask me any questions you need to be able to help me with this.

    The law changed over a year ago! But it didn't change that much (except for keeper liability, it didn't make these any more enforceable!). However this is no biggie.

    Two thoughts:

    1. See the 'Successful complaints about PPCs' sticky thread at the top of the forum here, and read in post #3 how to complain where it's a Hospital, going via 'PALS'.

    2. Please show us the Notice to Keeper (the first letter from Vinci). Maybe we can find enough non-compliant & misleading wording in it (front and back please!) to warrant a complaint to the BPA about it.

    You can't post full links yet so post broken link (remove the http:// from the URL once you have hosted your scans or photos on tinypic or photobucket, and of course cover the car reg/name/address and PCN number).

    First is this England or Wales ? You are passed the appeal stage so no point going there unless you were not the registered keeper. Your options really are either pay or not and that is it.

    The thing to do is put complaints into the nhs trust who employs these vermin to harass the sick, the pregnant and their visitors. As you obviously had more important things to do its shameful they allow this to happen. And I'm sure your wife is protected under the Equality Act 2010, as pregnancy is a protected characteristic .

    So don't write an appeal write a complaint to the nhs trust about their breach of the Act, say you are minded to sue them for the actions of their agents unless they cancel this unlawful penalty.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Thanks, though congrats may not be the right word as he has reflux and is slowly breaking me!

    It happened in England and I'm especially peeved as I put a small fortune in those meters over a few days in July (a few problems with the pregnancy) and a few days in September (more problems!). :(

    And congrats from me too, I am a Mum of 4 and have been there done that with reflux and a child who screamed through his entire first year!
