Redundancy question

At the end of August 2013 I was informed, after consultation, that I was being made redundant.


As I have been with the company for over twenty years, I have 3 months notice which runs out at the end of the month.


I was offered three months in lieu as well as the statutory redundancy and could have stayed at home in August but for work reasons have stayed on.


If they ask me to stay on (this is hypothetical btw), what is the then situation. Is it a new contract or continuous.


I am interested, just to be forewarned in case things happen a week on Friday or just before.

    Continuous - but since you are already at the maximum entitlement it won't make any difference to you - it doesn't stop the redundancy, it just delays it.

    If business has improved (or some other member of staff has resigned leaving work that you could do perhaps) and they ask you to stay on then your employment simply continues, it doesn't start afresh.

    So you have all the benefits of your long service and whatever that may mean in terms of enhanced holidays, company sick pay or entitlement to notice.

    It sounds as though you hadn't got another job lined up, so I hope that your dismissal doesn't go ahead.
