Help please

Hello.

My father has recieved a parking ticket from Parking Eye (through the post). I've read through some of the stuff on here, and according to my understanding if the claim isn't issued within 14 days (commencing day after the incident), then the claim is invalid. The letter itself says the incident was on the 29th of October and was issued on the 15th November (arriving on the 18th). Does this mean I should simply write back, pointing this out to them and asking them to withdraw the claim as it is invalid?

Should I stick to that simple line of defence, or should I bring in other arguments like poor lighting, bad signage etc?

    You should do a simple appeal to parking eye, then come back here and do your popla appeal, draft it up an we can check it up

    I would just stick to the known formula and go from there,

    I would write as "the keeper" to Parking Eye pointing out that their Notice to Keeper was outside the 14 day period proscribed by POFA 2012 and, therefore, the liability for the parking contravention can not be passed from the driver to the keeper.

    Given that, you are appealing as keeper to have the ticket cancelled as they are now prohibited by law from pursuing anyone except the driver.

    If they have any photographic evidence as to who was the driver, you will seek to ascertain who that was but failing that, cancel the ticket or issue a POPLA code.

    Add that should they continue to pursue you as keeper, then you will lodge an official complaint to BPA demanding sanction points be applied, a letter to Capita will also be sent informing them that their recent acquisition chooses to flout the law and you will use this as part of your appeal to POPLA.

    If it was a retail park and you have a receipt to show a copy of that is one of the easiest appeal points that work, sometimes. But write as the registered keeper only, not even saying 'my receipt' (= 'the driver's receipt').

    However at POPLA stage you would need the usual points posted on lots of threads here because receipts & mitigation don't win.
