Just received a letter from Lowell stating the following:
We refer to your recent request for a copy of the executed credit agreement under Section 77(1) and / or 78(1) of the Consumer Credit Act 1974. Please find enclosed the £1 sent with your letter.
Following investigations we have concluded that the debt is not linked to you. As such we have removed your personal details from the data base. We would recommend that you contact the credit reference bureaus to review your credit history, as your address was identified following a search of these. We have supplied the necessary contact details for your use.

Yes, because a default will most likely have been registered by Lowell for this, even though it wasn't you they were after, you need to contact each one, explain the situation, enclose a copy of lowells letter, and they should amend any derogatory info they hold on you in relation to this matter.Thanks FireWirm, I hear what you're saying, but I'm just relieved they have realised its not my debt.

Once again thanks to Sourcrates, Firewyrm, Happy_bunny for your input with this, the whole episode has given me an insight in this minefield...
Sourcrates, I'm just in the process of firing some letters at these credit bureau's so hopefully I can put the whole thing to bed soon.

Hi please be gentle with me im new to this site.
I am havin loads of problems wheni was with my ex husband he would not have anything in his name.
I left due to domestic violence and the police told me to get out before it was to late. I left with over £24,000 of debt.
Now im getting calls txts from capquest lowell and others.
I am no longer working due to ill health so on benefits.
I pau everyone £1 a month but when some one tells you that it will be finished in 2028 its just adding to my depression.
Now capquest are saying i didnot pay last month but i have proof from the bank as slip is date stamped.
Please can someone give me advice as im losing the plot and i cant take it.

Write to Capquest, headed 'complaint' including a copy of the payment slip informing them that you gave paid as per the enclosed slip and you expect it to be credited to your account.
As for the texts, you could write to each creditor insisting they deal in writing only and remove your phone numbers. Easier with some than others, but it's usually possible if you insist and threaten to take the matter to the FOS.:beer:0 -
