ParkingEye

Overstayed at a welcome break by 29 mins (2HR freeparking)got the pcn in the post. After couple of correspondences to Parking Eye after reading previous threads posted by people in the same situation they have eventually sent me a POPLA appeal form. My argument regarding the day in question is upon entering the car park a breakdown lorry was straddling about 5 parking bays and obstructing the signs posted at the rear of the car park. I parked adjacent to the next available parking bay next to the lorry. I feel asleep and outstayed the 2hr limit. I've since been back to the car park, and on entering the car park there is a sign but it's not noticeably visible driving in at car level. The day in question was also one of those fine rain overcast days where the last thing your looking at is signs for car parking. What is the best arguments to proceed with POPLA to make the appeal successful. Any advice would be most welcome.

  • Don't base your POPLA appeal on those mitigating circumstances or signage - it will fail. Read the links provided, and base your appeal on the winning points of Genuine Pre-Estimate of Loss and rights to offer contracts/enforce parking.
