Solicitor owes me money overpaid

Options
I wasn't sure where to put this, I set up a standing order for £150 per month to pay my solicitor.
The bill was 5000. I have a letter to say it was capped. I forgot to cancel the standing order and spoke to them at the end of August and several times since but they have not come back to say anything other than they are looking at it.
I calculate it's about 3000 overpaid. What can I do?
Grateful for any help.

you could send them a Letter Before Action sent recorded delivery giving them 14 days to repay the overpaid amount.

Hope you have now cancelled the SO

You could use the £3000 to hire them to sue themselves
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Send them one last letter giving them 7 days to respond to your request again with evidence of the overpayment. The threat is that you will make and official complaint to the law society, this is not who they want involved and will respond.

Thank you for all the advice it's much appreciated. I will write again and send a photocopy of the letter stating it's capped at £5000 and proof of my payments to them.

Is it the Law Society or the Solicitors Regulation Authority that would be the pertinent body to contact?

you would need to contact the SRA as the law society will only help you locate legal services for your needs.

  • Phone them up asking to speak to a solicitor regarding reclaiming money and see how long it takes them to cotton on.

You need to start by writing to whoever did the work for you or who was dealing with recovering your debt to them. Send them a breakdown of the payments you have made to them and ask them to please confirm the debt is now settled and to refund your overpayments.

You will need to give them time to check their accounts and sort out a statement, esepcially if they were charging interest on your debt (which is likely if you were paying it over such a long period). If you don't get a response within a reasonable period of time, say 2 weeks, write to their complaints manager and ask them to investigate.
