In addition get son to join a union and get them to take appropriate action.0 -
He has to be given written particulars within a certain time
Also you say he does 54 hours a week that's with no breaks or it would be more as he is working the breaks?
Is he on NMW?
The 54 hours include his lunch breaks AP . Not on NMWProthet_of_Doom wrote: »In addition get son to join a union and get them to take appropriate action.
I have suggested this to him Prothet , the question is if they became involved what will his employer do, obviously my son doesn't want to loose his job .
Thanks again everyone0 -

Ok may not be on NMW but does the fact he works 54 hours bring him down to NMWWe’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -

Thanks again for replying AP
As I said in my OP it's a family run business, other than my son the staff are all related so as they come & go as they please, including late starts/long lunch breaks and early finishes along with the odd day off here and there .0 -
I don't know what else to say but I know threat of the sack or not I would still take the 20 mins break I was entitled to by law. Thanks again for replying AP

If they fired me then well that's on their heads as a nice call to the HMRC would be a good xmas present for them

The whole 'if he has less than two years service, they can let him go for no reason' isn't exactly true. There are a number of instances where a dismissal can be automatically unfair and two years' service is irrelevant. One of these instances is assertion of a statutory right, which the no breaks thing could come under. So, if he rocked the boat on this and was dismissed for it and had some evidence of it, this would be unfair dismissal.0

When I was in my first job, which was also a family run business, the company moved buildings to a bigger office. There were signs all over the new office warning of asbestos. Owner wasn't bothered.
I didn't know at the time, but my parents reported this to environmental health, who came out and did an inspection. The next day some equipment was installed to measure asbestos in the air and a short time later all the asbestos was removed.
You could report anonymously and not tell your son until many years later (like my parents did).
There were slightly more staff though - there were 2 owners, 2 staff (including me) and 1 work placement student. I think they suspected me, but when I was quizzed I could honestly say that I hadn't reported them.0
