New Job . No contract . No Breaks .

Hi All ,

My son started a new job five months ago ( family business )

He still has no contract , has been told that he must work his lunch/tea breaks or he will be sacked . He also was told he would work every other Saturday but has worked the last six and is penciled in until Christmas.

Basically his employer has said he can do whatever he wants and if my son doesn't like it tough . I have a feeling his employer is correct, is he ?

Thanks for any advice .

    Unfortunately they can get shot of him very easily until he's been there or 2 years, if his shift is longer than 6 hours then by law he is entitled to a 20 min(depending on his age) break to be taken somewhere in the middle of his shift but not at the end. Demanding his rights are another matter.

    Sorry to hear this Mandi, but unfortunately this employer (like so many others) is taking advantage of the disgusting employment laws.

    While there are plenty of laws on his side that'd say the employer's a fool and the employee is 'entitled' to conditions based on rules ... the reality is if the boss is an 4rse then all of that's out of the window anyway. If he complains about anything, the boss can simply let him go without reason.

    How many hours a day does he work?

    Get him to ask for a contract and get the no break rule in writing

    Yes I thought so.

    Today he was sent out to get lunch for the owners son , only to be reprimanded when he got back for taking 15 mins break .

    The worst thing is that the boss was all smiles & promises when he headhunted him. He's totally miserable & constantly tired as you can imagine :(

    He has to be given written particulars within a certain time

    Also you say he does 54 hours a week that's with no breaks or it would be more as he is working the breaks?

  • Drop a call into HMRC regarding payroll, tax returns and the like. Anonymous call, inviting an investigation. And have your son find another job, because the employer will continue to pull this stuff until someone in any form of authority comes down on him, and that will not be your son.
    Some days, it's just not worth chewing through the leather straps....
