Bought some Body Wrap boxer type control underwear on Friday in a little independent shop to wear under trousers. Tried them on in the shop over tights and they seemed to be alright. However, I wore them out on the Friday and had to take them off half way during the evening because the legs kept rolling up. I didn't expect to get a full refund when I took them back this morning but to seemingly have no rights seems very unfair. They said as I had tried them on they were sold fit for purpose. However, standing there is hardly the same as moving around wearing under a different garment. Anybody know if I am entitled to anything or is this it I just have a very big pair of expensive pants sitting in my drawers (excuse the pun!) thanks in advance.

Frankly I'm amazed they allowed you to try on underwear. Most shops wouldn't for hygiene reasons.
I'm afraid that unless you can prove that the garment is unfit for purpose you have no rights at all. Unfit for purpose does not mean that it doesn't fit you or that you just don't like it. It would have to be incapable of doing what the manufacturer/retailer claims it can do.
You say you didn't expect a refund when you went back to the shop - what exactly did you expect?0 -

If its the type of garment I think it is, its not strictly underwear. More akin to a pair of shorts as they go over your underwear.

Er, every shop I've ever bought knickers from allows you to try them on, e.g. M&S, John Lewis, Debenhams etc. You have to keep your own cacks on underneath but, yeah, you can try them. I meant to wear them for a while to find out that they rolled up ! Not trying them on. The OP did try them on, she wasn't saying they didn't fit, just that the legs rolled up. You wouldn't find that out until you'd worn them for a while.0 -
