Pension overpayment

Hi help please on this . . . my father passed away on the 29.4. I contacted the DWp on the 1/5 and also his post office account to let them know what had happened. The Post Office account was closed on the18/5, none of the money in the account was touched by me. When I filled in the form for Post office account closure it said that if there was a payment to be made where would you like the payment to go to so I specified my bank account.....the money was paid into my account and is still there untouched but...today I have received a letter from DWP saying they are owed the money and an overpayment was made. The name of my father on the letter is wrong too.
The Dwp had good time to remove that money that was in his account should I give them a call??

    If you've let them know in plenty of time they should have stopped any more benefit payments going in so I'd suggest you appeal. However sometimes they ask you to pay the money back when it's been their own fault. This is called an offical error and not legally enforceable. You'll be able to tell this from the letter as it's a simple request for the money back but no mention of any appeal rights. You should seek some advice from CAB or other welfare rights agencies as they can take more info from you and advise accordingly
