Help please!

This morning I received a "notice to owner" from Defence Systems. This is the first letter I have had.

It alleges that on 23/08/2013 I was parked in a "no stopping" area and tells me I have 14 days to pay £60 or it will increase to £100, and it says:

"As the incident was captured by camera we had reasonable cause to apply to the DVLA for the keeper details to inform you of this charge"

Isn't this far too late to be sending a ticket? I thought they had 60 days to send it?

Also, there are 2 pictures on the letter of my vehicle, which clearly show me exiting the passenger side, thus not driving, so is the charge even applicable?

It just so happened that at the time, my husband was driving and he stopped for less than 30 seconds to let me out so that I could rush into the shop to get my daughter's prescription as it was raining. He didn't wait there, he drove off to find a space.

What should I do? I can't afford to pay it.

  • First of don't worry - you don't need to pay this.

Your first task is to read this thread - https://forums.moneysavingexpert.com/discussion/4816822

Secondly, this bunch appear to be a group of chancers - from their website :

"At DEFENCE SYSTEMS we believe in making life a little simpler. Parking your car at the local shopping centre, retail park, train station or at home should be stress free. However as we’re all aware, illegal parking can cause unnecessary aggravation and that is where our unique parking control systems can help you - whether you are a large corporate company or a lone resident."

"With many years experience in the parking control and enforcement industry, we pride ourselves on our professionalism and effectiveness in dealing with the public and in turn eradicating illegal parking from your premises."

Errr .... breaking the daft T&C's in a PRIVATE car park isn't ILLEGAL - unless this bunch of muppets wants to point me to an act of parliament showing otherwise !!!! Idiots !

    Spot the spelling mistake!

Please read the info thread linked by Hovite. They had to get this to you by day 15 UNLESS their letter doesn't mention the Protection of Freedoms Act nor 'registered keeper being liable'. Does it?

PLease refer to the linked thread for how to appeal and check you letter for compliance and how to report them to the BPA if they are citing POFA 2012.
