What to do??

Hi Everyone,

This is my first post so I hope this is ok. Please let me know if this is in the wrong place.

I have a problem at work and am taking legal advice, I have done nothing wrong and this looks like the option i will try is an exit agreement from my contract.

I have no idea what to do if this is accepted in terms of benefits and when I can claim them or if I can claim them. I have always worked, I don't get any child/working tax credit. I have just started an IVA following a divorce, I live in rented accommodation and have one child. I intend on working and am looking for a job but if I cant find one easily, how do I go about claiming benefits?

I have a partner who works but he has to pay out child support, even though his kids spend most of their time with us, so that has a impact on our income.

Im so confused - any help greatly appreciated.

  • Were you in regular employment/ pay NI in tax years 10/11 and 11/12? If so you will be eligible for contributions based JSA.

    Your claim may be sanctioned if the JCP decide that you chose to leave work. They will ask for your reasons and contact your employer before making this decision, so you need to ensure the employer will be saying the same as you.
  • I have always worked.

    I guess that an agreement for what reason my employment ends will need to be made via a solicitor.

    I don't really know how this works.

    you will make a claim and you will give your reason for leaving then they will contact your employer and ask for their side. Once they have the information they will decide whether a sanction is appropriate or not.
    Apart from CB JSA, any other benefits (tax credits, housing benefit etc) will be based on household income. This means your partners income - before any deductions for child maintenance come off

    If you are asking if you can claim JSA if you leave work - then unless you have had no choice but to leave - and the jobcentre agrees with this - you will not be entitled to JSA.

    Assuming your partner earns >150/week or so - you will not be entitled to any income based benefits at all.

    You would in principle be entitled to 6 months of contributory JSA - based on your past contributions - but not if you leave through your own choice.
    You actually need to have been let go - or for the jobcentre to agree that it was reasonable for you to leave.
    If this is not the case - you will not be entitled to JSA for an extended period as you will be sanctioned.

    You will not be entitled to hardship payments, as you are earning as a couple over the limit.

    Depending on what your partners hours and details are - WTC/CTC may now be possible.
  • Do you know what happens with working/child tax credit? can I claim and include my partners income, hes not her dad. Do I have to wait because its based on the previous years income??

    The benefit you will be claiming is Job Seekers Allowance.


    There might be two problems with this. First, you need to have worked for the past two tax years to be entitled to contribution based JSA. This is awarded regardless of any income from your partner's work or any savings of you both.


    If you are not eligible for this then you will not be eligible for income based JSA as this is dependent on household income and savings and your partner's income will take you over the threshold.


    Also if you resign from work you may be sanctioned for either JSA unless you can prove 'good reason' so it is vital that you check the circumstances of your leaving work.


    If your partner is working 24 hrs a week you might be entitled to tax credits depending on his income.


    Benefits do not take into account any outgoings as regards debts or child support.


    If you are having the children the majority of the time then it seems a review of the child support would be in order.
  • Thank you for replying. My partner works full time and his take home is about £350, but hes not my daughters dad. I have had a payout now but have an iva so need to work out what to do. I have never been unemployed so its all a bit much at the moment,
