Code 62 PCN

Hi Guys,

I've recently received a PCN for an alleged contravention of code 62 in the Kingston Upon Thames area.

The alleged breach occurred when I parked in front of my girlfriend's drive way when i came to pick her up. I would have parked in the road adjacent however there was an event at the school next to where she lives which meant there were absolutely no spaces in the road where i could park. Furthermore as I am recovering from a motorbike accident (3 torn ligaments and one rupture in my ankle) I still have great difficulty walking, especially for long distances. To complicate the situation my girlfriend has a shoulder injury which means she needs help carrying her bags et al.

As there are no signs advising you are not aloud to park in front of drive ways and there are many other drive ways in the road where other people park I did not think it would be an issue to park there.

Furthermore, the parking warden in question was standing 3 doors down when I parked an purposefully waited until I went to pick up my girlfriend indoors to come over and give me the ticket. I find this completely unreasonable as if he had told me to move the car forward in order to avoid the contravention I would have. Although I purposefully did not do this originally as I felt my car would have been too close to the road and would be dangerous for other cars, especially as the entrance of the drive way is on a corner.

My car is not obstructing people walking on the pavement, even with buggies or wheelchairs as there was a gap of 145cm wide.

It is also unclear where the pavement starts and finishes as there are no markings, I used the start of the pavement when crossing as the road as a guide, which shows my wheels are not on what could be considered the pavement.

I want to contest this as I think it was completely unreasonable, particularly as I was only there for maybe 10mins. Any tips, particularly with regards to points of law or previous similar contestations would be extremely appreciated!

    The code is for parking with either or all of the wheels on a pavement or footpath.
    Did you take pictures ?

  • Hi, yes I did but I can't currently attach them to my post as I'm a new user and mse won't let me. To try and explain I parked in front of a drive way which has a rather large dropped curb entrance to allow cars to cross the pavement into the drive way. The dropped curb section of the drive way / pavement is large enough to allow a car to park without obstructing the pavement. Which is where I parked.

    Hopefully I will be able to post pictures soon, but in the meantime have you ever dealt with any similar situations or suggestions? Thanks

    I think in your first appeal I would state that you had the permission of the resident to park there and needed to help load bags which the CEO watched you do and chose a moment when you were fetching a bag, to ticket the car. But see what pepipoo add because they get most people off most PCNs in the end (you have to go through up to 3 stages).
